Petition humbly sheweth that sometime in the month of November 1777 while he acted as Assistant Commissary for the tenth Regiment in the North Carolina line he found it very difficult to purchase provisions for the Army on the credit of the publick, that the Army got some what in confusion & likely to break when Coll Dozare gave him positive orders to purchase a quantity of beef, at any risk it must be had. Robert Maritt who was in possession of the cattle your petitioner bought wold not take any certificate more than an obligation from your petitioner to see him paid provided it was not other wise paid. On these terms your petitioner complyed with his order as aforesaid having no cash in hand & in about seven or eight years after this contract that Robert Maritt aforesaid said your petitioner on the obligation & received judgement for said contract for the sum of £138.12.0 though the cattle were actuly made use of by the Army aforesaid as will appear by the deposition of Willoughby Williams. Your petitioner further makes known that he never has either by himself or any other person received any satisfaction for said moneys. Petition humbly complaining sheweth that he intered in the Army on the first of August 1777 in character of Assistant Commissary & contractor in the tenth Regiment of the No. Carolina line & continued in that service till 4th of March 1778 at which time he rec'd a discharge but has sence lost it but nothing more for his service a part of which will appear by certificate of Col'o Abraham Sheppard & deposition Willoughby Williams both of which he your petitioner prays may be received in evidence & be considered as a part of his petition. Your petition further represents that his motive for leaving the Army at the time he did was because it was supplyed after that time by the publick stores and of corse cold be no further business for such an office. He therefore prays your Honourable body to make him such Allowance as in your wisdom ye shall think proper. In both the House and the Senate, Nov 27, 1795, read and referred to Committee. The Committee to whom as referred the petition of William Alford report that the petitioner, as appears from several vouchers, acted as Assistant Commissary in the tenth Regiment, in which character he purchased a number of cattle, but gave his note as a private individual for the same, which cattle appear to have been delivered to the issuing Commissary and were appropriated to the use of the Army, for which the petitioner has been bound to account, and complains he has never received any compensation for said purchase, not for his services in that capacity for one year. But from the information of several persons to your Committee they are of opinion that the principal Commissary, under whom the petitioner was appointed, in all probability has been allowed for the purchase of his assistant and his services also, as the Con'l of said regiment appears to have been vested with the power of raising, equipping and supporting said Troops there is the strongest reason to believe that the State has paid in full for the claim of the petitioner and until the contrary is made appear your Committee recommend that said petition be rejected.
