Court met according to adjournment

State vs Barna Jernigan

The Prisoner who had been convicted at a former term of this Court and who had 
appealed from the decision of this court being brought to the Bar and it 
appearing by the Certificate returned from the Supreme Court that the reasons 
offered in a writ of judgment are over ruled and that the Prisoner is not 
entitled to the benefits of Clergy on the first count in the indictment in which 
he was convicted.

John R. Donnel the Solicitor for the State prayed the judgment of the court 
against the Prisoner on the said first count in the indictment on which he was 
convicted when the court prounouced the following judgment accordingly:

It is the judgment and sentence of this court that the Prisoner Barna Jernigan 
be taken by the Sheriff from the Bar of this court to the place from where he 
came and from thence to the place of Publick execution and that he be hung by 
the neck until he be dead and that this judgment be carried into execution by 
the Sheriff of Wayne County on the twenty third day of this month April between 
the hours of ten and four o'clock A.M. of said day.
