To the Worshipfull the Justices of Wayne County Court
The Petitioner of Henry Carraway & Elizabeth his wife sheweth. That Benjamin 
Winston Caswell late of Wayne County died intestate in the year 1814 seized and 
posseseth in fee simple of a tract of land situate in Wayne County on the south 
side of Neuse River and on Sleepy Creek estimated to contain four hundred acres. 
The said lands descended to William Henry Caswell, the only child & heir at law 
to said Benj. W. Caswell. Your petitioner Elizabeth was the wife of said Benj. W. 
Caswell and entitled to dower in said tract of land. She has since intermarried 
with your petitioner Henry Carraway. Your petitioners desire that the dower of 
your petitioners Elizabeth in said land would be allotted to her. The said Wm. H. 
Caswell is an infant and has no guardian. May it please your worships to issue a 
subpoena to the said Wm. H. Caswell to appear before your worships at a day therein 
to be expressed & to shew cause if any he can wherefore the dower of your petitioner
Elizabeth should not be assigned her in said land & that the proper proceedings may 
be had for that purpose & your petitioners shall ever pray.
