Exceptions to Report made to Fall Term 1837

Wayne Superior Court Fall Term 1837

Chairman use of Henry Carraway & Wife et als vs Probert Collier

Defendant excepts to the report of the Commissioners made in this Cause

1. For that there was no evidence laid before the Commissioners to sustain the 
charge of $665.32 which purports to be the amount of notes inventoried as 
doubtful & desperate & ought not to have been charged against the Defendant.

2. For that there was no evidence to sustain the charge of $3037.12 purporting 
to be the amount of debt inventoried as doubtful & which ought not to have been 
charged against the defendant.

3. For that there was no evidence to sustain the charge of $368.94 purporting to 
be the amount of accounts inventoried as desperate & which ought not to have 
been charged against the defendant.

4. For that there was no evidence to sustain the charge of $1479.80 purporting 
to the amount of Sales.

5. He excepts to the several charges of interest on the above charges.

6. That the settlement made between William B. Green adm'r and Sampson Lane 
subsequently adm'r of Winston Caswell was not competent evidence to charge 
defendant.

7. That there is a suit and feuding in which Philip Hooks adm'r &c is relator, 
upon the bond sued upon in this action in which if any recovery is made the same 
is entitled to satisfaction prior to Ptffs; the relator being a Creditor.
