Hudson Source: www.familysearch.org Wayne Deed Records 1884-1885 Image 129 or 733 Microfilm of Vol. 52 page 184 North Carolina Wayne County This indenture made this 29th day of November 1884 between Rufus Andrews and his wife Fannie of the first part and C.J. Hudson of the second part all of the county of Wayne and State of NC. Witnesseth that said Rufus Andrews and Fannie his wife in consideration of Five Dollars to them paid the receipt of which is hereby acknowledged hath bargained and sold and by these presents doth convey unto said C.J. Hudson and his heirs a certain tract of land lying in Wayne County in said State and bounded as follows: Beginning at the western boundary (struch?) of Little Washington as a point 64 4/2 feet with said (struch?) from the intersection of said (struch?) with the public road leading from Goldsboro to Little River Bridge thence N70W 200 feet thence to the place of beginning and containing 307 Rds 7 yds and 8 feet more or less and the same lot conveyed to Rufus Andrews by J. Newton Green, atty by deed dated Dec. 20, 1874. To have and to hold the aforesaid tract of land to the said C.J. Hudson and his heirs and assigns forever. The conditions of this deed is that whereas the said Rufus Andrews is justly indebted to said C.J. Hudson in the sum of one hundred dollars by note bearing interest at 8 percent and due six months after date or on the 29 of May 1885 dated herewith and is honestly desirous of securing the same. Now Therefore if the said Rufus Andrews shall pay off and discharge said debt when due and the interest accruing thereon, then this deed shall be void. And it is further understood and agreed that in case the said Rufus Andrews shall fail to pay off said note, and interest when due then the said C.J. Hudson is Authorized and empowered to advertise said land at the court house door and three other public places in Wayne County for thirty days and after such advertisement sell the same for cash at the court house doo in Goldsboro and convey the same by deed to the purchaser and out of the proceeds of such sale pay the said debt and interest and all necessary expenses of making and executing this trust and the balance remaining he shall pay over to the said Rufus Andrews or his legal representatives. In witness thereof the said Rufus Andrews and Fannie his wife hath hereunto set their hands and seals this 29th day of Nov. 1884. Grady do hereby certify that Rufus Andrews and Fannie Andrews his wife personally appeared before me this day and acknowledge the due execution of the annexed mortgage and the said Fannie Andrews being by me privately examined separate and apart from her said husband touching her voluntary execution of the same doth state that she signed the same freely and voluntarily without fear of compulsion of her husband or any other person and that she doth still voluntarily assent thereto.
