Britt (November 10, 1894) State of North Carolina Wayne County This (Godsail?) or Last Will and testament of W. P. Britt made this November the tenth day in the year of our Lord one thousand eight hundred and ninety four. I being still sound in mind but infirm body do make this addition to my last Will and Testament, I W.P. Britt living indebted and unable to pay them without having my property subject to pay the same, I W. P. Britt now set apart a certain portion of money to the discharge of all my indebtedness. The amount here in named and itemized as follows. Smithy Jane McClerry (?) thirty five dollars. Clarky Patience Joyner thirty five dollars. James Richard Britt Seventy five dollars. Elizabeth Odum one hundred and twenty five dollars. Now if this my last Will and testament be complied with, severally according to this proportion this Will shall be in full force and effect. Otherwise this Will is null and void to every one that fails to comply with the terms of this instrument of writing. I further select J.M. Britt as my Executor to this my last Will and testament. Addendum added Item - I also set apart and give to my Granddaughter Pollie McCley the following named articles, one feather bed and two quilts, two sheets, two pillows and stead there into belonging but under this special trust that the said Pollie Ann McClerry Administer to my necessities during my natural life, otherwise this instrument will be null and void. Item - I also bequeath into Jane Myers as a reward for her faithful performance of duty one feather bed, two quilts, two sheets and two pillows, with the stead there into belonging but under this special trust that the said Jane Myers perform the duties required of her faithfully and impartially otherwise this Instrument will become null and Void. Britt (dated May 16, 1879 Wayne CO, NC) Last Will and Testament of William P. Britt I W. P. Britt of Wayne County North Carolina do make and declare this my last Will and testament, in manner and form following, that is to say- Item- I loan to my beloved wife Nancy Britt, during her natural life the plantation on which I now reside containing about two hundred and forty acres: I also loan to her during her natural life all my personal property and estate, except such as I give in a subsequent item of this Will to my son James Richard Britt. I loan said plantation and said personal property and estate to her during her life. Upon the condition that she pays my funeral expenses, my debts and the expenses of settling my estate. It is my will that she have the actual use and possession of said plantation and said personal property and estate during her life and it is further my will that she shall have full power to sell, consume and dispose of absolutely so much of said personal property and estate as she may think necessary for the payment of said funeral expenses, debts and charges of settling my estate and for the support of herself and her family during her life. Item- I give to my son James Richard Britt one sorrel horse now claimed by him, one cow and calf his choice, one sow and pigs his choice, one bed stead, bed and bed covering for one bed. I also give to my said son James Richard Britt the tract of land situated on Falling Creek in said county, adjoining the lands of Joshua Grantham, Rebecca Davis, James Jernegan, Wm. Boyett and Jesse Summerlin containing about one hundred and eighty four acres. It being the tract of land I bought of D. A. Grantham Admin. of W. R. Britt, dec’d. Item- I loan to my daughter Smithy Jane Clerry (McClerry?) during her natural life the plantation in said county on which she now resides containing about one hundred and fifty acres, it being the tract of land I purchased from Jesse Summerlin. At the death of the said Smithy Jane Clerry (?) I give said tract of land to such of her children as she may leave her surviving and to the issue of such as may be dead. Such issue to represent their ancestor and take such part as their ancestor would take if living. Item- At the death of my wife I give to my daughters, Clarky Patience Britt and Elizabeth Britt the plantation I loaned to my wife in a former item of this Will, to be equally divided between them. I also give to said Clarky Patience Britt and Elizabeth Britt at the death of my wife, all the personal property and estate I have loaned to her in the first item of this Will which she may not have sold, consumed or disposed of under the power given her in said item, to be equally divided between them. I appoint my wife Nancy Britt executix of this my last Will and hereby revoke all former wills by me made.
