Bunting of the state of North Carolina and county of Wayne being of sound mind and disposing memory do publish and ordain this as my last will and testament. First, I give and bequeath to my son-in-law Joel D. Battle whatever claim I may have against him at my death, whether by note or otherwise and do hereby discharge him from the payment of the same. Second, I devise and bequeath to my daughter Harriet D. Battle all my other worldly estate of whatever nature of sort real, personal and mixed including all my notes and accounts (except those due from her said husband as above stated) to the sole and separate use of my said daughter Harriet, free from the claims, control or debts of her said husband, to her for life only with power in her during her life time, to dispose of the same by deed or otherwise, and with power by her last will and testament or by writing in nature of a last will and testament to dispose of the same whether she be married or sole, but if she should die without so disposing of the same or any part of it, either by deed, gift or will then my will and desire is that all the lands and negroes hereby devised and bequeathed shall at the death of my said daughter Harriet go to said issues as she may leave living at her death. And if she die leaving no issue after death then my will and desire is that my said estate, so undisposed of, shall go to such person or persons as may at her death be my next of kin living, to be equally divided between them. Third, I hereby appoint my brother John C. Slocumb executor to this my last will and testament. Signed, published and declared on this the 4th day of March 1855. Julia A. Bunting (Seal) In presence of R. T. Haskins, G. W. Collier Wayne County Feb Term 1857 The foregoing paper writing purporting to be the last will and testament of Julia A. Bunting is propounded for probate by John C. Slocumb the executor therein named and the same is duly proved by the several oaths of R. T. Haskins and George W. Collier the subscribing witnesses thereto, who both depose that the said paper writing was executed in their presence and in the presence of each other and was published and declared by the testatrix to be her last will and testament on the date therein specified. And at the time of executing the same that the said Julia A. Bunting was of sound mind and disposing memory, whereupon the court doth declare the said paper writing to be the last will and testament of the late Julia A. Bunting and doth order the same together with the order of probate to be recorded. Thereupon John C. Slocumb appears in court and takes upon himself the burden of executing the same and takes the oath of an executor as prescribed by law. Let letters testamentary issue. Feb Co 1857 Benj. Aycock Clk ----- Notice The subscriber qualified as executor of the last will and testament of the late Julia A. Bunting at Feb Term 1857 of the court of Pleas & Quarter Sessions of the county of Wayne. All persons indebted to said estate are requested to settle and pay the same to the subscriber and all persons having accounts on demands against the same are hereby required to present them for payment within the time prescribed by law or this notice will be pleaded in bar of their recovery. Feb 19th, 1857 David B. Everitt maketh oath before me a Justice of the Peace in and for the county of Wayne that he saw copies of the within advertisement posted up in the following public places in the county of Wayne viz: At the court house in Goldsboro on the 21st day of Feby 1857, at the store of Andrews & Washington in Goldsboro on the 21st Feb 1857 and at the store of J.
