I William Carraway of the county and state aforesaid being in feeble health but of sound disposing mind and memory and calling to mind the uncertainty of life do make and ordain this instrument of writing to be and contain my last will and testament in manner and for following (Viz) Item first – I give unto my beloved wife Temperance R. Carraway the following named Negro slaves – Jack, Lila, Borden, Jane and her two children Lizzy and Ann, George (called White), Mary and Harriett and all their future increase. All of my household and kitchen furniture or as much as she may decree of it (except the Piano Forts), two mules, one horse her choice, my knockoways and horses, four cows and calves her choice, four sows and pigs her choice, my small wagon and one cart, one hundred and fifty barrels of corn, ten stacks fodder (blade), fifty bushels wheat, twenty bushels of rye, as many farming tools, plough gear &c as may be necessary for her for many purposes, two hundred and fifty bushels sweet potatoes, three thousand five hundred pounds of good fat pork, and two hundred dollars in cash, to her and her heirs forever. I also loan my beloved wife Temperance R. Carraway all that portion of my lands lying on the South side of Carraway Creek and on the west side of the public road called the Goshen Road leading from Spring Bank to Mount Olive during her natural life. I also loan her my Negro girl Charity until my daughter Mary Hinton Carraway arrives at the age of twenty one years. Item second – It is my will and desire that my interest in the Nixon House and lots in the Town of Goldsborough be held by my executor hereinafter named for the use of my children until such time as a majority of the stock holders shall decide to sell the same and thus the rents arising therefrom be equally divided between my five children or all the children I may have me surviving and in case a sale of said property the proceeds arising therefrom be divided between all my children equally. Item third – I give and bequeath unto my three sons, William Pope Carraway, John Thomas Carraway, and Charles Dennis Carraway, all the balance of my real estate not heretofore disposed of and also that portion loaned their mother after her death to be equally divided between them as they severally arrive at the age of twenty one years and they are to pay to my two daughters Mary Hinton Carraway and Louisa Andrews Carraway the sum of three thousand dollars in consequence of my having given them all may land to be paid as follows – the sum of fifteen hundred dollars to Mary Hinton Carraway when she arrives at the age of twenty one years and to Louisa Andrews fifteen hundred dollars when she arrives at the age of twenty one years and when the aforesaid sums are paid to my daughters I give the aforesaid lands to my sons aforesaid to them and their heirs forever. Item fourth – I give and bequeath unto my daughter Mary Hinton Carraway the Piano Forts I purchased for her. Also my Negro girl Charity when the said Mary Hinton shall attain the age of twenty one years, to her and her heirs forever. Item fifth – I give and bequeath unto my five children herein named all the balance of my Negroes which I may be possessed of at the time of my death to be equally divided between them to them and their heirs forever to be divided out as the said children shall arrive at the age of twenty one years. It is my will and desire that my executor herein named sell all the balance of my property not given away by this will and that amount of proceeds of such sale together with the amount which may be due me at my death that he pay all my just debts and after this if there be any balance remaining my will and desire is that such balance so remaining be equally divided between my children and their mother equally. Item seventh – I hereby nominate constitute and appoint my friend David B. Everett as Executor to this my last will and testament. Signed Sealed & Acknowledged Wm Carraway {Seal} in the presence of M. D. Craton Henry J. Carraway Wayne County November Term 1865 The foregoing paper writing purporting to be the last will and testament of William Carraway is offered for probate on the testimony of M. D. Craton and Henry Carraway the subscribing witnesses thereto. It is therefore considered by the Court that the said paper writing and every part thereof is the last will and testament of said Wm Carraway and the same is ordered to be filed and recorded. And thereupon D. B. Everett the Executor therein named is duly qualified and enters into bond of fifty thousand dollars with G. W. Collier and W. H. H. Cobb as securities which bond is accepted by the Court. And Temperance Carraway widow of said Wm Carraway comes into open Court by her attorney and dissents from said will and her said dissent is ordered to be entered on record. W. G.
