WAYNE COUNTY, NC - Will of Wright Casey File contributed for use in USGenWeb Archives by Guy Potts gpotts1@nc.rr.com Will of Wright Casey - October 18, 1874 Source - NC Archives I Wright Casey of the county of Wayne and State of North Carolina Being of Sound mind and Memory but considering the uncertainty of my Earthly Existence do make and declare this my Last Will and Testament in manner and form Following that is to say, 1st That my Executor hereinafter named shall provide for my body a decent burial suitable to the wishes of my relations and friends and pay all funeral expenses together with my just debts howsoever and to oweing out of the monies that may first come into his hands as a part or parcel of my Estate, (2) I give and devise to my beloved wife Charlotte Casey one bay horse colt and one first choice cow & calf and one first choice heifer two feather beds and furniture one sow and pigs all the poultry on the yard and one half of all the House Hold & Kitchen Furniture not bequeathed in the second Item and allso the one third part of all my lands for and during her natural lifetime to be selected by her one Jersey Waggon & horse. Item (3rd) I give and devise to my daughters Amy W Casey one cow and calf second choice one sow and pigs one feather bed and furniture known as her bed one set of sitting chairs and all the lands on the south side of the road leading from Dudly to White Hall coming at the mouth of the lane leading from the house to the road and running with the corn rows now existing in the field on the south side of said road and on the east side of the lane that runs thrugh the plantation on said south side of the road said line to extend back thrugh the field to the Whitfields line. Item 4th I give and devise to my son James H Casey all that part of my lands lying west of a line to commence at the mash girth and to run in such direction as to run with the lane running from the house to the road through the yard Said land being on North side of the White Hall Road allso all the personal property not conveyed in this instrument often first - Paying off and discharging all my just debts including one hundred dollars to be paid to Amy W Casey in Twelve months after death. Item (5th) I give and devise to my daughter Martha Eliza Barwick the sum of five dollars in the Currency of the United States. Item (6th) I give and devise to my three daughters viz Hepsey Wood (Hood?), Vicey Ann Jones and Elizabeth Casey all the lands not before conveyed in this Will to my son Jas H Casey and my daughter Amy W Casey to equally divided between the three that is to say Hepsey, Vicey Ann and Elizabeth by Cleats and Bounds. And lastly I do hereby constitute and appoint my son James H Casey my lawful Executor to all interests and purposes to Execute this my Last Will and Testament according to the true intent and meaning of the same and every part and cleanse others of hereby revoking and declaring utterily void all other Wills and Testaments by me heretofore made in witness whereof I the said Wright Casey do hereunto set my hand and seal this the Eighteenth day of October AD 1875. Wright Casey (Seal) Signed Sealed and Published and delared by the said Wright Casey to be his Last Will and Testament in the Presence of us who at his request and in his desire do Subscribe our names as Witness thereto Jethro Jones A T Grady Wright Casey Will North Carolina, Wayne County In Probate Court A paper writing purporting to be the last will and Testament of Wright Casey bearing date the 18th day of October AD 1875 is thus offered for Probate on the evidence of Jethrow Jones and A T Grady the subscribing witnesses is therefore considered by the county that this said paper writing and every part thereof is the last will and Testament of the said Wright Casey thereto and the same is duly forever and after submitted to Probate and Jas H Casey the Executor therein named is duly qualified by the witnesses and subscribing the oaths prescribed by law Nov 15th 1875 W T Yelverton, Probate Judge Application For Letters Testamentary - Printed and for sale by Nichols & Gorman, Raleigh, NC Wayne County: - In the Probate Court In the matter of the Will of Wright Casey Before W T Yelverton, Judge of Probate James H Casey being sworn doth say: That Wright Casey, late of said County, is dead, having first made and published his last Will and Testament; and that James H Casey is the executor named therein. Further, that the property of the said Wright Casey consisting of Household & Kitchen furniture about 75 barrels corn about 5 bales cotton farming utensils Hogs cattle one colt is worth about $1,000 so far as can be ascertained at the date of this application; and that Charlotte Casey, Amy W Casey, James H Casey, Martha E Barwick, Hepsey Hood residing in Wayne County, NC, Vicey A Jones residing in Duplin County, NC, Elizabeth Casey residing at Camden South Carolina, are parties entitled under said Will to the said property.
