Collier and Peole P. Collier fifty dollars each and no more. I having already given them all I intended to as a full share of my estate. Secondly - I give and bequeath to my beloved wife Elizabeth the following Negroes Viz, Old Sam, Esther and her children, Abram, York, Old Charity, Violet and her children, Tenor, Jim, Ransom, Laura, Julia, Charity and George, William son of Tenor and Ceaser, also one half of my household and kitchen furniture except three beds, steads and furniture, all the corn in the sawed log crib and all the wheat on hand, three thousand pounds bacon, three barrells pork, five bushels sale and all the sugar coffee and molasses that I may have at my death for her year's provisions. I do also lend to my wife Elizabeth during her natural life as her dower in my lands, the Betty Carraway field, the barn and graveyard fields, the Mill and Millfield, my dwelling house and homestead and the Starling field with timber adjoining the same sufficient only for the repairing of the buildings thereon, erecting necessary outhouses and other necessary repairs and uses of said plantations. Thirdly - I give and bequeath to my daughter Sarah Morin Hall the following Negroes Viz, big Robin, Ned, Lewis, Cuff and Hannah, the three last of whom are now in the possession of her husband Willis Hall. I Having already made otherwise to her considerable advancements. Fourthly - I give and bequeath to my daughter Eliza West the following Negroes Viz, Tenor, Glisson, Speight, Edy, Drew, little Robin, Henry, Rackey and her child, and Beckey and Furnez who are now in the possession of her husband John W. S. West also three other Negroes Viz, Hannah, Quilla and Marzilla. Fifthly - I give and bequeath unto my two sons John J. Collier and George W. Collier and my daughter Ann S. Cobb, the following Negroes Viz, Nathan, Mary, Big Stephen, Penny, Ellick, Gilley, little Silvia, Alfred, little Barna, Simon, Rhoda, Bryan, Isaac, Moses, Nat, John, old Barna, Hannah, little Stephen, Jerry, Tom, Salisbury, Cloe, Betsey, Lovick, Probert, Dollsbury, Nancy, Grace, Olive, Eliza, old Silvia, Martha, Betsey and Augustus, Sam, Saunders, Winney, Mordecai, Oliver and Sarah, and Kizey and Cherry to be equally divided between them. I also give and bequeath to my sons John J. Collier and George W. Collier and my daughter Ann S. Cobb each one feather bed, furniture and bedstead. Sixthly - I give and bequeath the remaining one half of my household and kitchen furniture to my two sons John J. and George W. and my three daughters Sarah M., Eliza and Ann S. to be equally divided between them. Seventhly - All the residue of my estate consisting of my stock in the Bank of Newbern, all my farming utensils, all my stock of every description and all of my crop on hand which has not heretofore been disposed of and two Negro men, Sam Altman and Ben, I leave to be sold on a credit of twelve months with interest from the date. Eightly - It is my desire that the sum of one hundred dollars if so much be necessary shall be reserved from the proceeds of the sale of my personal estate or from the monies on hand for the purpose of erecting a vault for the interment of myself and family. It is also my desire that my son in law Willis Hall shall superintend the erection of the same. Ninthly - After all my just debts shall have been paid out of the monies on hand or the proceeds of my personal estate directed to be sold I give and bequeath unto my wife Elizabeth Collier, my three daughters Sarah M. Hall, Eliza West and Ann S. Cobb and my two sons John J. Collier and George W. Collier the whole and net proceeds of the property so directed to be sold all the monies on hand, all the debts due me at my death and the books of my library, to be equally divided between them. Lastly - I do hereby revoke all former wills by me made. In witness whereof I have hereunto set my hand and affixed my seal this [blank] day in the year of our Lord one thousand eight hundred and thirty. Signed Sealed published and declared P. Collier {Seal} by the above named Probert Colier to be his last will and testament in the presence of us who have hereunto sub- scribed our names as witnesses in the presence of the testator and in the presence of each other James Griswold Charles Carraway John McKinne Wayne County Feby Term 1835 Then was the above will of Probert Collier offered for probate and proved in due form of law by the oaths of James Griswold, Charles Caraway & John McKinne, the subscribing witnesses thereto whereupon it is ordered by the court that the same be recorded. It appearing to the court that there are no executors named in said will & the relinquishment of Eliza Collier the widdow of said Probert being exhibited it is ordered by the court that letters of administration with the will of said Probert be granted to James Griswold and Needham G. Bryan on their entering into bond in the sum of fifty thousand dollars with Jno. J. Collier and Willis Hall securities - let letters testimentary issue. Jno. A. Green Clk ----- Notice At the February term 1835 of the Court of Pleas and Quarter Sessions of Wayne County the subscribers qualified as administrators (with the will amend) of the estate of Probert Collier, Esqr dec'd. All person indebted to the estate are requested to make immediate payment and those having claims against it are required to present them properly authenticated within the time prescribed by law or this notice will be plead in bar of their recovery. February 17th, 1835. Notice Will be sold on Wednesday the 11th March 1835 at the late residence of Probert Collier Esqr deceased in Wayne County upon a credit of twelve months with interest from the dae the perishable property of said deceased consisting of a large stock of all description such as hogs, horses, mules, cattle, sheep and goats, a fine and very likely young horse called Sir Richard whose blood is inferior to but few in the state, also between 30 and 40 bales of cotton, a quantity of corn, fodder, peas, oats &c, 12 shares of the stock of the Bank of Newbern and farming tools of every description with a variety of other articles too tedious to mention the purchasers will be required to give bond with two good and sufficient securities before the property is delivered. Feby 17th, 1835. May Co 1835 Gabriel Sherard maketh oath that he saw copies of the within two advertisements upon the post of his Gin House on the side of the road near his house the week of Feby Court 1835. Nicholson Washington maketh oath that he put up copies of the within advertisements at his store house in Wayne County sometime during the week of Feby Court last past of which is there still remaining.
