All rights reserved. http://www.usgwarchives.net/copyright.htm This file was contributed for use in the USGenWeb Archives by Guy Potts - egpotts@gmail.com To all whom these presents shall come know ye that I Smithson Cox of the County of Wayne and State of North Carolina do make and ordain this my last will and testament in manner and form as follows First my will is that as much of my estate be sold by my executors as they shall think proper to settle my just debts My will further is that I give to my son Lancaster Cox the sum of fifty cents I give and bequeath to my daughter Michel Jinnett to her and her heirs forever a certain tract of land lying in the County of Johnston and State aforesaid containing two hundred acres be it the same more or less which I purchased of Cullin Talton I give and bequeath to my daughter Zilphy Moon to her and her heirs forever a certain tract of land lying in the County of Johnston and State aforesaid containing two hundred acres more or less which I purchased of [illegible] I lend to my beloved wife the whole of my estate so long as she remains my widdow after the expiration of her widdowhood I give and bequeath the tract of land whereon I live to my two daughters Elizabeth Grantham and Sarah Rhodes to them and their heirs forever to be equally divided between them at the discresion of my executors The remaining part of my estate to be sold by my executors and the money arising there from I care to be divided as follows: I give to my daughter Michel Jinnett one hundred dollars The remaining part to be divided between all my daughters namely Michel, Zilphy, Anna, Elizabeth and Sarah My will further is that if either of my two daughters Elizabeth and Sarah decease without a lawful heir that their part of sd land be divided equally between the surviving sisters Lastly I nominate and appoint my two friends Micajah Cox and Levi Cox executors to this my last will in witness whereof I have hereunto set my hand and seal this 10th day of the 7th month 1826 Witnesses: Daniel Cox and Wm R Grice Wayne County May Term 1828 Then was the within will of Smithson Cox duly proved in open court by the oath of Daniel Cox a subscribing witness and at the same time Levi Cox one of the within named executors appeared in open court and was duly qualified as executor & let letters of Testmentary issue
