Viz: I recommend my Soul to God that gave it and my body to the earth to be buried in a plain and decent manner according to the discretion of my Executors. And as to my outward estate I leave and bequeath to my loving wife Mary my manor plantation during her widowhood together with the plantation tools. Also I give to her and her heirs forever one bed and furniture, one young mare two cows and one watch. And an equal share of the rest of my personal estate which I leave to be divided between her and my four daughters: Sarah, Mary, Lydia and Anna my books only excepted which I leave to be equally divided as near as may be between my wife and children. Item 1: I give to my son, Micajah an equal share of my books as aforesaid having already given him the portion which I allotted for him. Item 2: I give and bequeath to my sons Richard, Thomas and Walter and to their several heirs all my land on the river to be equally divided according to the discretion of my Executors. Item 3: I give to my son John and his heirs my water mill and the lands on both sides of the creek to me belonging. Lastly, I ordain my son, Micajah and my brother-in-law, John Kennedy Executors and my wife Executrix to this my Will revoking all other former Wills by me made. In witness whereof I have hereunto set my hand and affixed my seal the day and year within written. Richard Cox Signed and sealed and acknowledged in presence of: Richard Cox Smithson Cox The Last Will and Testament of RICHARD COX was placed into probate at the January Court 1785 in Wayne County, North Carolina. According to family legend, RICHARD COX died from injuries sustained in a fall while building a new grist mill. Perhaps he was aware that he was dying when he wrote his Last Will and Testament on 13 October 1784, as he died several weeks later on 30 October.
