Wayne County, NC - Will of Barna Daniel, 1893 ~~~~~~~~~~~~~~~~~~~~~~~~~~ I BARNA DANIEL, of Wayne County, North Carolina being of sound mind and memory, do make and publish this my last will and testament. ITEM 1 My executor hereinafter named shall provide for my body a decent burial, and pay all funeral expenses, and all my debts out of the money which shall first come into his hands. ITEM 2 I give and devise to my wife MARTHA DANIEL, during her life , in lieu of dower, that portion of the land on which I reside, on the north side of my big ditch. ITEM 3 I give and bequeath to my said wife absolutely, one horse and buggy, five hundred dollars in cash and a years provisions. ITEM 4 I give and bequeath to my said wife, during her life, the use of one cart and the necessary tools for the work of one horse, two beds and furniture, one cow and calf, two sows and pigs, all the poultry on hand and all the household and kitchen furniture on hand and at her death, what may remain of the same, I give and bequeath to my daughters ELIZABETH DAVIS and LYDIA DANIEL. ITEM 5 All the balance of my personal estate to be sold by my executor and the proceeds thereof, and all debts owing to me to be collected and paid over to my said daughters equally. ITEM 6 I give and devise to my daughter ELIZABETH DAVIS during her life one half of the land on the south side of the big ditch, bounded as follows (then gives description of the lines) and on her death, I give and devise said land to her children then living and to the issue of such as may be dead, leaving issue, such issue to represent the parent and take such share as the parent would take if living. ITEM 7 I give and devise to my daughter LYDIA DANIEL during her life, that part of my land on the north side of my big ditch, subject to my wife's dower named in Item two, and on her death I give and devise the same to her children then living and to the issue of such as may be dead, leaving issue, such issue to represent the parent and take such share as the parent would take, if living. ITEM 8 I give and devise to my said daughters, ELIZABETH DAVIS and LYDIA DANIEL, during their lives to be equally divided between them, the other half of the land on the south side of my big ditch, not given to ELIZAETH DAVIS in item 6 and which I call the Savannah piece (then gives description) and on the death of either of my said daughters, I give and devise her share of said land to her children then living and to the issue of such as may be dead leaving issue, such issue to represent the parent and take such share as the parent would, if living. ITEM 9 I give bequeath and devise to my said daughters any and all property and estate, if there be such not named in this will. ITEM 10 I hereby appoint my son-in-law WILLIAM DANIEL, executor of this will. In witness whereof, I have hereunto set my hand and seal this 4th day of May 1884. DORTCH I, BARNA DANIEL, do make and declare and publish this codicil to my will, dated the 4th day of May 1884, to be construed as part thereof, as follows, to wit: I hereby revoke so much of Item 3 as gives to my wife five hundred dollars in cash: and subject to the revocation, I hereby ratify, confirm and republish my said will.
