I, Daniel Lofley of this state of North Carolina and County of Wayne being sick and weak of Body but of a right mind and Memory thanks be given unto Almighty God for his mercies calling to mind the Mortality of body and knowing that it is appointed for all Men once to die and for the better settling of my Worldly Estate do make and publish this my last will and Testament in Manner and form Following as Viz Tis my Will and Desire that my Beloved wife Sarah Lofley have the use of my plantation and and lands belonging thereunto only except all the lands that lies on the South side (torn) Slough and on the upper side of the (torn) that leads to James Sofsers which I give and Bequeath to my son Right Lofley, During her Natural life and after her decease I desire that my son Jesse Lofley have all the Remainder part of my land on the South side of the Slough and my son John Lofley all my land on the North side of the Slough to them their Heirs of assigns forever. I give and bequeath to my Daughter Sarah Worrell ten shillings. I give my son Pitmon Lofley twenty shillings. I desire that my wife let my two daughters Patience and Leah each of them have one feather bed and furniture when they leave her or before if she sees cause and I desire that my share Bounce (?) be sold and the Mony to pay my Debts and if any left I desire that it be applied to school my small children. I lend to my Beloved wife all my Estate Real and Personal during her Natural life or good pleasure and after her decease I desire that the same be equally divided between my four children : Patience, Leah, John, Avey and if my wife ____ ______ at any time before her Decease (torn) the Estate lent her. I desire that the same be divided unto five equal parts and shares and my four children last named take each of them one part to them and their heirs forever. Lastly I constitute my Beloved wife my Exectr and Right Lofley Exectr of this my last Will and Testiment and I do hereby utterly dismiss and revoke all and every other will and testiment by me made or published Justifying and confirming this and no other will and Testiment in witness whereof I (torn) Hereunto set my hand, (torn) Day of June 1801 Daniel Lofley (his mark) Signed sealed and published and declared by the Testator Daniel Lofley as his last will and testement in the presence of us who in the presence of each other have hereunto ________ names: John ____ll John Thompson Augt.
