Wayne County, NC - Will & Estate Records Posted with permission of Thomas Elmore, descendant Will of John E Elmore - 1821 Born - ca 1770-80 Died - 1821 In the name of God Amen I John Elmore of the State of North Carolina and County of Wayne being weak of body but sound mind and perfect understanding thanks be unto the Lord for his mercy and calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this instrument to contain my last will and testament and desire all men to receive it as such in the manner and form following now First of all I recommend my soul unto the hands of God that gave it me and my body to the Earth to be buried in a decent Christian burial Secondly my wish and desier further is that all my just debts be paid out of my Estate with such property as can be best spaired to be sold for that purpose Thirdly my wish and desier further is that I give my two sons James and Everett Elmore two colts that is to say James to have one more colt and Everett to have one horse colt Fourthly my wish and desier is that I give unto my twelve children that is to say James, Everett, Zelpha, Amey, Eliza, Harriet, Cassy, Elsa, William, Lincy, Elijah and Alfred each to have one dollar as they come of age, my further desier is that I give unto my son Alfred Elmore sixteen Dollars to be paid out of my estate when he arrives to the age of twenty one years Fifthly my wish and desier further is that if my wife should be delivered of another child or children within nine months after the making of this will that it or they should have one dollar each Sixthly my wish and desier further is that I lend unto my wife Martha Elmore all my property that is not before given away for her support and children during her natural life or widowhood Seventhly and lastly I constitute nominate and appoint Samuel Bizzell Executor to this my last will and testament John Elmore {Seal} Signed, sealed, acknowleged to be his last will and testament in the presents of us this 21st day of February 1821 Richard Ivey Richard Hinson Henry (his x mark) Skipper Wayne County May Term 1821 Then was exhibited in open Court the last will and testament of John Elmore which was duly proved by the oath of Richard Ivey and Richard Hinson subscribing witnesses and the executors named in said will failing to appear and qualifying to said will.
