Wayne County, NC - Will of Josiah Gardner, 1865


I JOSIAH GARDNER of the County of Wayne and 
State of North Carolina Being of Sound mind and 
Body but considering the uncertainty of my worldy 
existence do make and declare this my last will 
and testament in manner and part following that 
is to say first that my executor herein after named 
shall provide for my body a decent burial suitable 
to the wishes of my relations and friends and pay 
all funeral expenses together with any just debts 
whatever owing out of the money that may first 
come into his hands as part or parcel of my 
estate.
Item 1st I give and devise to my wife SEALY 
GARDNER two hundred dollars in money all my 
household and kitchen furniture except one feather 
bed and five barrels of seed corn due from 
Daniel Gardner to her and her heirs for ever.
Item 2nd I give and devise to my son WILLIAM 
T. GARDNER all my land lying on the North side of 
the road leading from Goldsboro to Bull Head, 
all my notes on hand, all my stock on hand and 
one feather bed to him and his heirs for 
ever and lastly I do hereby constitute and 
appoint my son WILLIAM T. GARDNER my lawful 
executor to all interests and purposes to 
execute this my last will and testament 
according to the intent and meaning of the 
same and every part and clause thereof hereby 
revoking and declaring entirely void all other wills 
and testaments by me heretofore made.  
As witness whereof I the said JOSIAH GARDNER do 
here unto set my hand and seal this 
the 1st day of June A. D. 1863.

The forgoing paper writing purporting to be the 
last will and testamen of JOSIAH GARDNER
offered for probate on the testimony of A. J. 
FINLAYSON one of the subscribing witnesses thereto is 
duly proved & admitted __ probate as the last 
will and Testament the said Josiah Gardner 
& is ordered to be recorded & W. T. GARDNER the 
executor therein named is duly qualified & 
enters into bond in the sum of Twenty 
five hundred dollars with A.J. FINLAYSON & 
T.T. HOLLOWELL Sureties. (signed) W.G. HOLLOWELL Clr
