Wayne County, NC - Will of Willis Hall, 1856 ~~~~~~~~~~ Will of Willis Hall - Wayne Co., NC 17 June 1856 In the name of God, Amen, I, Willis Hall, of the County of Wayne, being of sound mind, do make & dictate this my last Will & testament as follows- Item 1- I give & bequeath to my executor hereinafter named all of my stock in the Willmington & Weldon Rail Road Company, in trust to receive the dividends for ten years after my death, and to pay out of the said dividends annually the sum of Three hundred dollars to "The Board of Foreign Missions of the Presbyterian Church in the United States of America" for foreign missionary purposes of the Presbyterian Church (Old School) & the balance of said dividends during said ten years I give to my son, William J. Hall & my daughter, Elizabeth A.M. Dyer equally - and at the end of said ten years, I give said Rail Road stock absolutely to all of my grand children then living to be equally divided between them. Item 2. I direct my Executor to purchase & have put up a suitable monument over my two deceased grand children. Item 3. I direct my Executor to appropriate two hundred dollars, as my part, for the purchase & and putting up of an iron fence around the family grave yard at George W. Collier's old place. Item 4 I give & bequeath to my son, William J. Hall, the following slaves with their increase from the date of this will- Viz- Lewis, Caesar, Sam, Henderson, Edmund, Rigdon, John, David, George, Jess, Laney, Bash, Casy, Esther, Vilet, Edith, Caroline, Charlotte, Jane, Sarah, Julia Ann, Fred, Sarah, Vilet, Hawkins, Dicey, Laney, Talton, Allen, & Emily. Item 5- I give and bequeath to my daughter Elizabeth the following slaves, viz, Robin, Nancy, Daniel, Bama, Probert, Charity, James, Clara, Betsey, Thomas, Louisa, Christian, Hepsey, Ellie, Kizzy, & Eliza- Item 6- I give & bequeath the following slaves, viz, Polly, Maria, Dolly, Bryan, Charles, Lorena, Nelson, Ellick, Joseph, Joshua, Phebe, Julia & Hunt to George W. Collier, in trust, for the sole & separate use of my daughter, Elizabeth, during her natural life and after her death to her children or their issue- the said Trustee may, however, permit my said daughter to have possession of said slaves. Item 7- I give and devise to my son, William J. the following real estate, all the Ezekiel Slocumb land- the balance of the Martin land unsold- all the West land unsold- and the balance of the John Caraway land unsold- and the following lots in the Town of Goldsboro, viz, nos. Three hundred & one (301) Three hundred & two (302) Three hundred & three (303) Three hundred & four (304) Two hundred & sixty one (261) Two hundred & sixty two (262) Two hundred & sixty three (263) & Two hundred and sixty four (264) Item 8- I give & devise to my daughter Elizabeth the following real estate- the home plantation containing alltogether about thirteen hundred acres- and the following lots in Goldsboro: viz nos Two hundred & sixty five (265) Three hundred & five (305) Three hundred & six (306) Three hundred & seven (307) & three hundred & eight (308) and the following other lots in said town, viz - Two hundred & ninety five (295) Two hundred & ninety six (296) & a small piece of land across the street just without the corporate limits of the Town purchased by me from E.B. Borden on condition that she surrender to William J. Hall a note for one thousand dollars which she or her husband holds against him. Item 9 I give & devise to my daughter, Elizabeth, during her life & after her death to her children, the following real estate in the Town of Goldsboro, viz, lots nos Two hundred & fifty five (255), Two hundred & fifty six (256) & part of two hundred & fifty four (254) Item 10 I give & devise to my Executor the following lots in the Town of Goldsboro viz that part of no Two hundred & seventeen (217) now belonging to me & nos Two hundred & eighteen (218), Two hundred & nineteen (219), Two hundred & twenty (220) Two hundred & twenty one (221) Two hundred & twenty two (222) Two hundred & twenty three (223) & two hundred & twenty four (224)- in trust for the use of such children as son, William J. & my daughter, Elizabeth, now have or may hereafter have. Item 11 I have this day given by deed to my grand-daughter, Susan M. Hall lot no one hundred & seventy three (173) in the Town of Goldsboro, on which brick buildings are now being erected, which I direct to be completed by my Executor out of money belonging to my estate- and I hereby give and bequeath to my son and daughter aforesaid, William & Elizabeth the rents of said Brick buildings & lot no one hundred & seventy three (173) for 5 years from the completion of said buildings to be equally divided between them. Item 12- I direct my Executor to complete the buildings on lot no Two hundred & ninety six, herein given to my daughter, & to have a neat wooden fence put up around the same. Item 13- I direct my Executor to appropriate Two hundred dollars for the education of Henry (or King?) C. Collier. Item 14- I hereby appoint my son, William J. Hall & George W. Collier executors to this my last will & testament. In witness whereof, I have hereunto set my hand & seal this 17th day of June AD 1856. Witness- John B. Griswold Wm. T. Dortch signed Willis Hall (seal) CODICIL North Carolina Wayne County Whereas I Willis Hall have made my last will and testament in writing bearing date 17th day of June A.D. 1856 and since that time my grand daughter Susan M. Hall mentioned in the eleventh item of my said will has departed this life and an infant brother of said Susan M. has been born by the name of George Peole Collier Hall. Now by this my writing which I declare to be a codicil to my said will to be taken and construed as part thereof I do hereby devise the estate given to the said Susan M. in said eleventh item unto the aforesaid George Peole Collier Hall and his heirs and it is my wish that in all other respects the said eleventh item remain unchanged I bequeath to my executors fifty dollars to be paid by them and expended to the advancement of the Colportage association of the county of Wayne. I further bequeath to my said executors the sum of twenty five dollars to be by them expended in the purchase of suitable books for the various Sunday schools of Wayne County. Cobb _____ " CODICIL 2 State of North Carolina Wayne County Whereas I Willis Hall have made my last will and testament in writing bearing the date the 17th of June A.D. 1856 Now by this my writing which I declare to be a codicil to my said will and to be taken and construed as part thereof It is my wish that James B. Alford of Randolph County state aforesaid would have the control and education of Willis H. Alford and his sister Fanny Alford children of Clarissa Alford and for the education of said children and for no other purpose whatever I bequest and require of my executors at the time of seven years from this time to pay out of my estate the sum of five hundred dollars annually for the time of five years to the said James B. Alford for the sole purpose of this education and nothing else Provided however that their mother Clarissa Alford and guardian do give them up at that time to the said James B. Alford to him to have the entire controll and management of them while being educated and raising up. Should mother Clarissa and their guardian to said Willis & Fanny refuse or object to the said James B. Alford having the entire controll and management of said children in their raising and education this a codicil to my last will and testament shall be null and void otherwise to have full force and effect- I testimony I have hereunto set my hand and seal this this January 5th 1857. D Cobb and Needham B Cobb the subscribing witnesses thereto and is duly proved-- also another codicil attached thereto bearing date January 5th 1857 is offered for probate on the testimony of Samuel Smith and Wm. D Cobb the subscribing witnesses thereto and is duly proved according to law and admitted to probate as the last will and testament of the said Willis Hall and are on hand? to be recorded and George W.
