Wayne County, NC - Will of Celia Herring, 1848 ~~~~~~~~~~~~~~~~~~~~~~~~~ I CELIA HERRING of the State of North Carolina and County of Wayne being of sound disproving mind and memory do make and publish and declare this writing to be and contain my last will and testament in manner and form following. viz: In the first place I give and bequeath to my Granddaughter MORNING GARRIS one bed bedstead and furniture and one hundred dollars in money to be paid by my Executor in twelve months after the probate of this my will to her, her heirs and assigns forever. Secondly I give and bequeath all balance of my estate after paying all my just debts and funeral expenses to my daughter SMITHY GARRIS to her, her heirs and assigns forever. Lastly I nominate constitute and appoint my son-in-law JOHN GARRIS Executor to execute this my last will and testament utterly annulling revoking and declaring void all former will or wills by me heretofore made and declaring this and no other to be my only true last will and testament. In witness whereof I have hereunto set my hand and seal this the 15 th day of November AD 1845. Signed sealed published and declared CELIA (X) HERRING Seal by the testatrix to be her last will and testament who signed the same in the presence of us and who at her request signed the same in her presence and in the presence of each other as witness thereunto JOHN A GREEN J K GREEN CODICIL TO CELIA HERRING WILL Whereas I CELIA HERRING having made my last will and testament bearing date the 15 th day of November 1845. I have thereby made sundry bequests according to the then existing circumstances of my estate, but which circumstances having now maternally changed. I do by this writing, which I hereby declare to be a codicil to my said will to be taken and construed as a part thereof. Will and desire that in addition to what I have heretofore given away in my said will, I give and bequeath to my daughter MORNING THOMAS the sum of one hundred dollars to her, her heirs and assigns forever, to be paid by my executor within twelve months after the probate of this my last will and codicil. In testimony whereof I have hereunto set my hand this the 16 th day of October 1847.
