Wayne County, NC - Will of James Herring, 1845 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ In the name of God, amen. I JAMES HERRING of the State of North Carolina and Wayne County being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following, that is to say. FIRST That my executors (hereinafter named) shall pay all my just debts out of the monies that may first come into their hands as a part of my estate. SECOND I give and bequeath unto my two sons JAMES and BENJAMIN five shillings each, having already given them (and my son JOEL HERRING, deceased) all I intended to, by sundry advancements and by separate deeds of gift for lands to each of them which said deeds I do hereby ratify and confirm. THIRD I give and devise unto my seven daughters ELIZABETH HARRIS ANNE HERRING ZILPHA HERRING ABIGAIL HERRING EDITH HERRING EDNEY HERRING & CATHERINE HERRING all that part of my land where I now reside lying on the east side of the west prong of Powell's run conveyed to me by my father, SIMON HERRING, dec'd and all my land lying on the east side of said west prong of Powell's run which I purchased from John O. Whitfield all of said land to be held by them in common and other use rents or profits thereof to go to such of my daughters as may remain unmarried during the natural life of my afflicted daughter, EDNEY, or until such time as they or the survivors may be general & unan- imous consent agree to divide or otherwise dispose of the same. FOURTH I also give and bequeath unto my said seven daughters herein- after mentioned my negro man Ham Amos and all the rest and remainder of my estate of what nature soever (not heretofore given away) and in case of the death of one or more of my said daughters without lawful issue then the share or shares of such as may have died to be equally divided between the survivors or their representatives per stripe. FIFTH It is my will and desire that my executors if at any time my said unmarried daughters shall request it, shall sell said negro man, Amos and also sell such part of my perishable estate as they may believe may be best for the interest of my said unmarried daughters and divide the monies arising therefrom after my just debts and legacies shall be paid between my said seven daughters or their legal representatives. LASTLY I do hereby nominate and appoint my sons JAMES HERRING and BENJAMIN HERRING executors of this my last will and testament, hereby revoking all other wills by me made.
