Hodges Will of Abia Herring (1882) I Abia Herring of the (word missing - must be "county") of Wayne and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following: That is to say first that my herein after named Executors shall provide for my body a decent burial and pay all funeral expenses together with my just debts however and to whomsoever owing out of the money that may first come into his hands as a part or parcel of my estate. Item first I loan unto my bloved (sic) wife Cuzza Herring during her natural life the lands on which I now live as follows: Beginning at the cross fence in Ichabod Grants line and run with said cross fence and a ditch to Hiram Hams line then with his line across the swamp to a water corner then strait (sic) to Lemuel Herrings corner then with his line so onto his corner at the page place then around with my line to the Beginning Item 2nd I give and devise unto my son John Herring all the land which I have loaned unto my wife after her death also one cow and calf to have and to hold to him and his in fee simple forever Item 3rd I give and devise unto my son Lemuel N. Herring the lands on which he now lives as follows: Beginning at a water oak corner now down, Hiram Hams corner and runs with his line to upper Bouge Swamp then with his line to the end of the lane between myself and Frank Lathan then with said Lathans line to his own corner near the page place then with the said Lemuels and John Herrings line to the Beginning also one other tract of land on the north side of the Big Swamp adjoining the lands of Henry Grant and others containing eighty-six acres to have and to hold to him and his heirs in fee simple forever. Item 4th I give and devise unto my son Henry Herring one part of my land as folows (sic): Beginning in Hiram Hams line on a ditch in the (savanah?) and with Hiram Hams line to the sand hills then down the edge of the (savanah?) with Henry Hams and Ichbod Grants line to George Dalys corner then with Ichabod Grants line through the (savanah?) to a corner on the west side of the (savanah?) then with Ichabod Grants line to the end of the cross fence between Henry and John then with said cross fence to the Beginning to have and to hold to him and his heirs in fee simple forever only if he should sale it for more than two hundred twenty Dollars he shall divide what is over two hundred and twenty Dollars with the rest of my children. I want George, Malvine, and Virginia W. to have each one cow and calf to have and to hold to them in fee simple forever. I enjoin upon my two sons John and Lemuel to pay over to my other children as follows that is to say John must pay one hundred Dollars to James and five hundred Dollars to George and to Mary Ann three hundred and seventy-five Dollars. Lemuel must pay Malvine and Virginia W. three hundred and seventy-five Dollars each. And lastly I do hereby constitute and appoint my son John my lawful Executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof hereby utterly revoking and declaring void all other wills and testaments by me heretofore made in witness whereof I the said Abia Herring do hereunto set my hand and seal this the 21st day of November A.
