Wayne County, NC - Will of John Hines, 1868 ¤¤¤¤¤¤ Will of John Hines I, John Hines of the County of Wayne and the State of North Carolina being in feeble health but of sound and disposing mind and memory make and declare this to be my last will and testament in manner and form following (viz) Item first it is my desire that my Executor hereinafter named provide for my mortal remains a decent burial suitable to the wishes of my family and friends, and pay all of my first debts to whomsoever owing out of the first money that comes into his hands as part or parsel of my estate. Item, I give and desire to my beloved wife Jane Hines two hundred acres of land whereon I now live including my dwelling and all out houses and improvements on the Same to have and to hold to her the said Jane Hines for and during her natural life or widowhood at he inspiration of which my desire is that the said land be divided between my three sons, Edwin Hines, Jethro G Hines, Zadock Hines in the following manner. All the land on the east side of Hollands Branch to be equally divided between Edwin Hines and Jethro G Hines Share and Share alike and in case either of them should die the survivor to have all of the said tract, the remaining portion I give to my son Zadock Hines to have and to hold to him and his heirs in fee simple forever in case he should die I desire the survivor or survivors shall have the share set forth for him provided that neither of them be married in that case their children shall inherit. Item, I give my beloved wife Jane Hines all my personal property of every description during her natural life or widowhood at the inspiration of which I desire that it be divided between my children in the following manner that is to say I give my son Zadock Hines one bed, stead, and furniture to him and his heirs forever. Item, I give to my daughter Mary one bed, stead, and furniture she now claims to her and her heirs forever. Item, I give to my daughter Edith Hines one bed, stead, and furniture to her and her heirs forever. Item, I give to my daughter Chelly Hines one bed, stead, and furniture to her and her heirs forever. The balance of my property I desire to be sold at public sale and the money equally divided between all my children to share and share alike. And lastly I do hereby constitute and appoint my trusty friend Jackson Rains my lawful Executor to all intents and purposes to execute this my last will and testament according the the true intent and meaning of the Same and every part and clause thereof in witness whereof I the said John Hines do hereunto set my hand and seal this the 16th day of March A.D. 1868.
