Wayne County, NC - Wills & Estates - Christopher Heins - 1847 File contributed for use in USGenWeb Archives by Guy Potts A copy of the original was sent to me by Cathy Blow, Goldsboro, NC Estate Record of Christopher Heins Book 22 page 81 Date 1851 Description 270a State of North Carolina To all persons to whome these presents shall come Ollin Coor High Sheriff of the County of Wayne in the state of North Carolina sends the Greeting. Whereas by a writ of Fieri Facias issued of the County Court of Pleas & Quarter Sessions for the County of Wayne bearing test the third Monday of Feby AD 1847 last part and to the said Sheriff directed he was commanded that of the lands and tenaments of the Heirs of Christopher Hines is to be found in his County he should cause to be made the sum of six hundred & Eleven dollars and thirty one cents thereon which Edwin Jones John Hines & other lately in the said court recovered for their debt and damage against the said Heirs of Christopher Hines and which were then and there adjudged to the said Plaintiff for their debt and damages And also the further sum of one hundred & sixty five dollars and thirty cents which were then and there adjudged & the said Plaintiff for their costs and charges by them in their said suit expended and whereof the said Heirs of C Hines was liable as appears of record and that he should have this said money before the said court on the 3rd Monday of May AD 1847 then next ensuing then and there to render to the said Plaintiff the said money for their debts damages and costs and that he should have then and there that writ And whereas also the said Sheriff did on that day returne to the said court that by virtue of said writ to him directed he had served and taken in execution a certain piece or parcel of land situate lying and being in the County of Wayne joining heirs of Edward Laker Elizabeth Hastings Jno Hines & others And whereas the said Sheriff having given due and legal notice of the time and place of sale of the sale of the said land did on the 19th day of Apl AD 1847 expose the same to sale by public vendue or out cry and sold the same to John Kennedy for the sum of six hundred & fifteen dollars he being the highest bidder and that the higest and best price bidden for the same Now Know ye that the said Sheriff for and in consideration of the aforesaid sum of six hundred & fifteen dollars to him in hand paid the said Jno Kennedy at and before the unsealing and delivery of these presents the receipt whereof he doth hereby acknowledge hath given granted bargained and sold and by these presents according to the directions of the said recited writ and by force and virtue thereof doth give grant bargain and sell unto the said Jno Kennedy his heirs and assigns all the said above described lands and tenements together with all and singular the building improvements rights members and appurtenances whatsoever thereunto belonging or in any wise appertaining and the revenues and remainder rents issues and profits thereof and also all the estate right title interest claims or demand of the said Heirs of Christopher Hines of in to or out of the same to have and to hold the said lands tenaments hereditaments and premises hereby granted or intended to be granted with the appurtenances unto the said Jno Kennedy his heirs and assigns to his and their only proper use and behoof forever for such estate and under such rents conditions and limitations as the said Heirs of Christopher Hines had and held the same at and immediately before the taking thereof in execution but for no other or greater estate then the said Heirs of C Hines then and there held the same according to the form and effect of the laws and usages of the State of North Carolina in such case made and proveded In witness whereof the said Sheriff hath hereunto set his hand and affixed his seal this 20th day of Sept AD 1847} O Coor Shff Seal Signed Sealed and delivered in presence of} Jno A Green G C Moses Wayne County Feby term 1851 Then was the above deed of sale from Ollin Coor Sheriff to John Kennedy duly acknowledged in open court ordered to be registered ============================================================== USGENWEB NOTICE: In keeping with our policy of providing free information on the Internet, data may be used by non-commercial entities, as long as this message remains on all copied material.
