I Curtis Hooks of the County of Wayne and State of North Carolina being of sound disposing mind and memory do make and publish this my last will and testament in manner and form following (Viz) Item 1st - I give and bequeath unto my beloved wife Ann W. Hooks the following property Viz five Negro slaves, Martha, Roina, Laura, Mariam & Lewis together with all their future increase, two beds, bed stead and furniture her choice, two horses Jane and Paris, two cows & calves her choice, three sows and pigs her choice, six ewes and lambs her choice, one buggy, one years provisions for herself and family to her and her heirs forever. I also leave to my beloved wife Ann W. Hooks during her natural life the following property Viz - my other Negro slaves Mathew, Sylva & Bob. One yoke of oxen and ox cart, one horse cart, all necessary farming tools of every description her choice, my houses and lots in Everettsville, all my household and kitchen furniture not given away in this will and the following land and buildings on the north side of Little River as follows Viz - beginning at the mouth of the swamp where the same empties into Little River, then down the river as the same meanders to a white oak formerly the dividing corner between my brother, Albert G. Hooks and myself, then with the drain to the mouth of a ditch then with the ditch as the same meanders to the first fork of said ditch then with the left prong of the ditch to the head, then with the hill to a mulberry tree on the path, thence to a mulberry tree where the old land used to run, then to the head of a bottom near the lower corner of the orchard, then down the meanders of the bottom to a branch, then down the turn of the branch as the same meanders to the run of the swamp, then down the run of the swamp to the beginning, also the growing shed and the lots around it the shed of the smoke house and the Negro house next to the road or path, with free ingress and egress thereto. Item 2d - I give and bequeath unto my beloved daughter Caroline E. Fitsgerald the following property Viz - one lot and the improvements therein in the town of Goldsborough and known in the plan of said town as No [blank], my Negro slaves Aaron, Phillis, Peny and her two children Lany, Georgiana and George and Malchus and all their future increase, three beds, bed stead and furniture, one thousand dollars in cash and after the death of my beloved wife Ann W. Hooks, I also give my said daughter Caroline E. Fitsgerald my house and lots in Everittsville and my two Negroes Mathew and Sylva and all their future increase, one half of all the household and kitchen furniture loaned to my beloved wife Ann W. Hooks and one half of all the balance of my estate not herein specifically given away to her and her heirs forever. It is my will and desire that the following property (to wit) all of my lands and improvements on the north side of Little River not loaned to my wife Ann W. Hooks and after her death that portion also containing about six hundred and eighty acres, my Negro slaves Mary, Margrett, Moses, Ben, Roda and child, Harry, Patience and child, with all their future increase, three beds, bed steads and furniture, one Boranch, and after the death of my wife Ann W. Hooks my Negro man Bob and one half of the household and kitchen furniture loaned to my said wife Ann W. Hooks, together with one half of the residue of my estate not specifically given away be held by my executor hereinafter named for the sole and separate use of my beloved daughter Nancy Malvina Sheras during her natural life and at her death if she should leave any child or children or the specie of such her surviving, then and in that case all of the aforesaid property to belong to the child or children or the specie of any one who may have died leaving issue such issue to represent the percent and take such part as he or she or the issue of such would if living but should the said Nancy Malvina die without a child or children or the specie of such then and in this case I give all the aforesaid property to my beloved daughter Caroline E. Fitsgerald to her and her heirs forever. I hereby nominate constitute and appoint my friend William K. Lane Executor to this my last will and testament hereby notifying and confirming this to be my last will and testament revoking and annulling all other wills by me made Signed Sealed and acknowledged in the presence of this 2d day of May 1854 Wm. Everitt Wayne County Augt Term 1854 The foregoing paper writing purporting to be the last will and testament of Curtis Hooks is offered for probate on the testimony of David B. Everitt one of the subscribing witnesses thereto and is duly proved and admitted to probate and whereupon Wm. K. Lane the Executor therein named is duly qualified. Benj.
