Of the Sate of North Carolina and county of Wayne, being Very sick and weak in Body but of a Sound Perfect mind and memory, thanks be To Almighty God for the same. Calling to mind the Mortality of my body knowing That it is appointed for all men Once to die, do Constitute make and Ordain this My Last Will, and Testament in the following manner and form_ Principally, And first of all I Recommend my Soul into the hands of Almighty God that gave it me And my body I recommend to the Earth, to be Decently Buried at the Discretion Of my Executors hereafter named_ Nothing doubting but at the General Resurrection I Shall Receive the same again by the Mighty Power of God; And as touching Such Worldly Estate, as it hath Pleased God of his mercy to bless me with in this Life, I do give and dispose of the same in Manner and form following_ Viz: First, my will and desire is that all my Just Debts and Funeral Charges be Cleared An Discharged~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Item| I Give and bequeath to my well beloved Wife Alice Jernigan Thirty Pounds Specie to be at her own Disposal_ And, I Lend to my said wife during her Widowhood or life, The use of the Plantation where on I now dwell with all my Houses and Orchards thereon, with all the rest of my Lands and Teniments on the North side of Neuse River to cut Timber and Raise Stock on any Part that Suits her best, I also Lend her During her Widowhood the use of Thirteen negroes Viz_ Tom, Cesar Cuffey Kadar Ned, Jim Phillip fann, Dick Judia Vitel Sambo and Galloway- And all my horses & mairs two Yoke of Oxen and Twenty Cows and Calves and thirty head of Dry Cattle her choice of all my Stock And all my Sheep and hogs Except four Ews and Lambs~~~~~~~~~~~~~~~~~~~ And likwise all my working Tools of all kinds with all my Hows and Hoes And all other Plantation Utensils of all kinds whatever_and likewise all my and as much of my household furniture as She Pleases to take herself Casks of all Sorts__^__and after my wife’s Widowhood or Death my Cyder Casks Of all kinds I Give to my son Stephen Jernigan~~~~~~~~~~~~~~~~~~~~~~~~~~~ Item|I Give and bequeath to my son David Jernigan all my Lands and Tenements on the South side of Neuse River, Except three hundred Acres two hundred acres of which is held By Deed from William Lee and the other hundred Pattented by myself to him and His heir for ever_ Item|I do give and bequeath to my son Stephen Jernigan all my Lands and Tenements on the North side of Neuse River-and likewise three hundred acres On the South side Including the Plantation I Purchased from William Lee and One Hundred Acres Joining the same Pattented by myself and likewise ten Cows & Calves And four Ews & Lams to him & his heirs for ever~~~Refer to the other side~~~ [next page] Item| I Lend to my son in law Solomon Herring the use of two Negroes now in his Possession Viz: Beck and Simon During his life - and the rest of the Increase Of the said negor Beck I Leave to be Equally Divided Between my Grand Daugh =ter Sally Herring and my Grand son Stephen Herring when the said Sally Herring Either marry’s Or Arrives at twenty years of Age-and After the Death of My son in law Solomon Herring the said beck and Simon with the all the rest of the Increase of the sd. Beck, I leave likewise to be Equally Divided Between the said Sally Herring and Stephen Herring~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Item| I Give and bequeath to my Grand Daughter Polly Harrison One likely young Negro to be taken Out of my Daughter Isabel Howells Part of my Estate when ever The same is Divided_ by my Executors But in case the said Polly Harrison Dies Without an heir that then the said negro to belong to my Daughter Isabel Howell and her heirs forever~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ And all the rest of my Estate both Real and Personal that is not mentioned in This my Last Will and Testament-I leave to be Equally Divided after my decease Amongst my Six Children Viz: David, Patty, Mary, Isabel, Alice & Stephen by Men Chosen by my Executors - and after my Wife’s Widowhood or Death my Desire is that the negroes I have Lent to her with all their Increase and all The Rest of my Estate so Lent, I likewise leave to be equally Divided amongst My Said Sid Children above mentioned~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Item| I do hereby appoint my beloved wife Alice Jernigan Executrix and my son David Jernigan Executor to this my Last Will and Testament And I do hereby Utterly Revoke Disannul and make Void all and every Other former Will or Wills heretofore by me made Ratifying and Confirming this and No Other to be my Last will and Testament.
