In John's will it mentions "if my wife should be delivered of a son or a daughter" and it is proposed this was Michael who was a minor in 1823 in the following record. ----- John's Estate Papers An Inventory of the Estate of John McKinne dec'd taken 25 May 1804 - Negroes Dick, Isaac, Bobb, Cloe, Zeney, Hannah and child Jack. May Term 1805 - Ordered that John Hurst, Probert Collier and James Bradbury be appointed a Committee to settle the accounts between the executors of John McKinne dec'd and William McKinne Guardian to the orphans of David McKinne dec'd and report to this present term. Sale of the property of John McKinne dec'd sold 10 Oct 1808 - Buyers were, Uriah Bass Junr William Boykin, Reuben Burket, John Carraway, Daniel Cogdell, Joseph Everitt, William Fellow, Needham Grantham, Samuel Hart, John Humphrey Junr, John Hurst, Benjamin Jernigan, Barnabas McKinne, John McKinne, Michael McKinne, Richard McKinne, William McKinne, James Musgrave, William Robins, Edmund Simms, John Thompson, Nicholson Washington and Benjamin Wilson. Sale of property of John McKinne dec'd sold the 10th day of October 1808 at six months credit. Everett Recorded November Court 1814 Appearance Bond 9 Nov 1808 - John Carraway and Elizabeth Carraway to answer unto William McKinne Executor of John McKinne dec'd in a plea of trespass on the case to his damage one hundred pounds. It is proposed the following Michael was born after John's will was written. November Term 1814 - We have valued the Negroes belonging to the estate of John McKinne dec'd between Charles Carraway in right of his wife Sally and Michael McKinne as follows: Lot No. 1 drawn by Michael received Isaac, Tom, Chloe and Amy. Lot No. 2 drawn by Charles & Sally Carraway received Dick, Zenah, Jacob and Penny. Recorded Feb'y Court 1815 1815 February Term - Court issued an order to examine and settle the acounts of John Carraway as Guardian aforesaid and find a ballance of 509 pounds, 12 shillings and three pence due to said Sally and Michael; 257 pounds, 12 shillings and 11 pence of which is due to Sally and 251 pounds, nineteen shillings and four pence due to Michael. John McKinne Sen'r Orphan's Account current with John Carraway. Orphans Account 9 May 1815 - Pursuant to an order of Court issued Feb'y Term 1815 we have examined and settled the accounts of John Carraway as Guardian and find the within balance of 509 pounds 12 shillings and three pence in his hands due to said Sally and Michael bearing interest from Feb'y Court 1815. 20 Aug 1817 - For value received with interest from the date hereof to pay Charles Caraway guardian to Michael McKinne $298.58. Slave names mentioned in Estate papers: Amy, Bobb, Chloe, Dick, Hannah & child Jack, Isaac, Jacob, Penny, Tom and Zenah. ----- John's Last Will and Testament NC Archives, Wayne County Wills Will of John McKinne - Recorded May Court 1804 May the 3rd 1804 - I John McKinne of the County of Wayne in the State of North Carolina being in my senses in sound and perfect memory but being sick and remembering the mortality of my body do make and ordain this my last will and testament in manner and form following: Item I lend to my beloved wife Elizabeth McKinne all my lands, Negroes, horses and stock of all kinds also all my beds and house hold furniture of all kinds with my plantation tools and every other part of my estate except for much of my stock and other small things as my executors may think best to sell to pay my just debts with during her widow hood or until my oldest children shall to arrive to twenty one years old. Item My will and desire is that my three sons John, Matthew and David McKinne their heirs and assigns forever should have all my lands equally divided between them at the others arriving to the age of twenty one years. Item My will and desire is that my daughter Sally McKinne her heirs and assigns forever shall have as many of my Negroes and as much money as will make her share equal in value to her brothers parts of my land when divided. Item My will and desire is that if my wife should be delivered of a son or a daughter that it should share equally with my daughter Sally and her brothers of my Negroes and money till it gets & has its full share in value to make it as much as all or any of the brothers or sisters to that its heirs and assigns for ever. Item I wish all my notes now in hand with all other part of my estate that is not given away to be equally divided between all my children at the division of my estate. It is my will and desire that my executors shall have full power to sell or rent out any part of my estate as may appear best to them or likely to come to heart and I doth further wish an equal division in all my estate when my oldest child arrives to full age or my wife should marry and then I wish her to have a child part of all my pearshable part of my estate. Lastly my will and desire is that my brother William McKinne, William Pope and Joseph Everett should act as executors to this my last will and testament in witness hereof I have here unto set my hand and affixed my seal the day and date above written.
