All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Linda Harmon trekkergen@gmail.com August 31, 2015, 12:33 pm Source: Raleigh State Archives, North Carolina Written: April 3, 1880 Recorded: December 1880 State of North Carolina Wayne County WILL OF WILEY MOORING I Wiley Mooring of the County and State aforesaid being of sound mind and me memory but considering the uncertainty of my earthly existence do make and de declare this my last Will and Testament in manner and form following-that is to sa say First: That my executor hereinafter named, shal provide for my body a decent buriel buriel suitable to the wishes of my relatives and friends and pay all funeral expencis, together with my just debts whosoever and to whomsoever owing out of th the moneys that may first come into his hands as a part or parcel of my estate ITEM: I give and devise unto my beloved wife Malvina Mooring for and during her her natural life or widowhood fifty acres of the tract of land on which I now resi reside and known as lot No 4 as my lands stand now divided and bounded as foll follows: Beginning at a stake the corner of No 3 and runs thence No ½ W 4900 chains to a st stake the corner of Lot No 3 on the canal of Watery Branch the up the meanders of of the same to a stake the corner of Lot No 5, thence with line? Of Lot No 5 S ½ ½ Eth 250 chains to a stake the corner of Lot No 5 thence 78 Eth 1100 chains to th the first station containing fifty acres more or less, but on the express co condition that after her death or marriage, said land shall revert to my da daughter, Nancy Mooring and give it to her and her heirs in fee simple forever. ITEM: I give and devise unto my beloved wife Malvina one hundred and twenty $120.00 in gold ? cow and calf one bed bedstead and covering for the same her choice six walnut chairs all of my kitchen firsniture all my crockery one cart he her choice one sow and eight shoats her choice and one large chest to her and he her heirs in few simple forever. ITEM: I also give to my wife Malvina the growing crop on land fifty acres on land devised to her in a former item of this will if there should be enough and in lieu of a years support to her and her heirs in fee simple forever. ITEM: I give and devise unto my daughter Nancy Mooring one bed bedstead and cove covering for the same her choice after her mother one trunk and one hundred $100 $100.00 dollars in cash to her and her heirs in fee simple forever. ITEM: I give and devise unto my son John R. Mooring five dollars $5.00 in cash to to him and his heirs in fee simple forever. ITEM: It is my wish and desire that the residue of my land not disposed of in this will be sold by my executor and the proceeds arising therefrom be equally divided between Zilph Edmondson wife of Briant Edmondson Sooky Bradshaw wife of Jefferson Bradshaw James Edmondson son of Patsy Edmondson and William Edmondson son of Elizabeth and Briant Edmondson do them and their heirs in fee simple fore forever. I give (crossed through) and devise unto my daughter Martha Lewis one hundred do dollars in cash and if there should ? be enough of the residue of my estate to pa pay the same it is my will that it come on T? of the lands given to my wife and da daughter Nancy in a former item of this will to her and her heirs in fee simple fo forever. ITEM: I give in addition to that all ready give to my wife Malvina five head of sheep one bofat one beans one loom and gear and one wheel and for-- cards and tw and two bee hives once cotton planter and my dog Butch? ITEM: I also give unto my daughter Nancy five head of sheep and six head of goat goats to her and her heirs in fee simple forever. ITEM: The residue of my property after being sold by my executor the proceeds as as being therefrom shall equally divided between all of my children except my so son John and Bryant to them and their heirs in fee simple forever. ITEM: I give and devise unto my daughter Marth Lewis one piece of land know as Lot No 6 in the division of my land adjoining the land of Jefferson Hagin, B D Yelverton and other containing 25 acres to her and her heirs in fee simple forever. And lastly I do hereby constitute and appoint my trusty friend L. D. Hooks my lawful executor to all intents and purposes to execute this my last Will and Testament according to the true intent and meaning of the same and every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments by me heretofore made. I witness whereof I the said Wiley Mooring have hereunto set my hand and seal this the 2 day of April AD 1880 Signed sealed and published Wiley (X – his mark) Mooring (SEAL) To be my last Will and Testament In the presence of Bryant Lane Fred J. Becton CODICIL Codicil to the forgoing will Whereas I Wiley C. Mooring have made my last Will and Testament in writing bearing date on the 3 day of April 1880 and have therein made in marked? devises and bequest in as only to the theron existing or circumstances of my estate but which are circumstances having been materially assigned I do by this writing which I hereby declare to be a codicil to my said will be to him and constrained as last testament will and direct that the sum of one hundred $100.00 given to my daughter Martha Lewis wife of William Lewis in a former item of my will be stricken on entirely and that the said one hundred $100.00 be paid to my son John R. Mooring by my executor in lieu of the five dollars given to my son John R. Mooring in a former item of my will and hereby give it to him and his heirs in fee simple forever. Lastly I do hereby constitute and appoint my trusty friend Fred J. Becton my lawful executor to all intents and purposes in place of L. D. Hooks appointed in my will.
