Wayne County, NC - Will of Richard A. Newsom, 1901 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~ North Carolina Wayne County I, RICHARD A. NEWSOME of aforesaid County and State, being of sound mind, but considering the uncertainty of my earthly existence, do make and declare this my last will and testament. FIRST My executors hereinafter named, shall give my body a decent burial, suitable to the wishes of my family and friends, and pay all funeral expenses, together with all just debts, out of the first money which may come into their hands, belonging to my estate. SECOND I give and bequeath to my grand children by my daughter AMIGENE PEEL forty-four acres of land on Hood Swamp. THIRD I give and bequeath to my daughter RACHEY BETTIE JOHNSON and to the heirs of her body eighty-two and one half acres of land which I purchased from COUNCIL BEST, reserving to my wife, SMITHEY A. NEWSOME her life estate in the dwelling, out houses and yard, also in the orchard field, and what is known as the W.B. NEWSOME field, and also one acre and tenant house, situate thereon, in what is known as the W.B. NEWSOME new ground, all of which is a part of said eighty-two and one half acres. FOURTH I give and bequeath to my daughter RACHEY BETTIE JOHNSON one half interest in forty-four acres of land in the piney woods, and to my grand children WILLIE GRAY, CLEM GRAY and CLAUDIUS GRAY, the other one-half interest in said forty-four acres, reserving to my wife SMITHY A. NEWSOME her life estate in the one-half interest bequeathed to WILLIE, CLEM and CLAUDIUS GRAY. FIFTH My will and desire is that all debts owing me be collected and if there be any surplus over and above the payment of my just debts and funeral expenses, that such surplus shall be paid over to and belong to my wife, SMITHY A. NEWSOME. SIXTH That all of my household and kitchen furniture shall be and remain in the possession of my wife, SMITHY A. NEWSOME, together with all other personal property that may belong to my estate, to be held by her for own benefit, during her natural life. After the death of said SMITHY A. NEWSOME, said furniture and other personal property to be equally divided among my heirs. SEVENTH I hereby constitute and approve my wife SMITHY A. NEWSOME and SIMPSON SMITH my lawful executors to all intent and purposes to execute this my last will and testament, according to the true intent and meaning of the same and every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments heretofore made by me. NEWSOME of the county of Wayne and State of North Carolina do make and declare this codicil to my last will and testament which is dated Aug. 3rd 1895. 1. I loan to my wife SMITHEY A. NEWSOM three acres of woodland adjoining my orchard on the east of my dwelling. 2. My will and desire is that my wife SMITHIE A. NEWSOME shall dig marrel as she needs it on the lot of land which I give my daughter RACHEL BETTIE JOHNSON. In witness whereof I have hereunto affixed my hand and seal. This Feb. 26th 1900. R. A.
