Wayne County, NC - Will of Joel Newsom, 1837 ~~~~~~~~~~~~~~~~~~~~~~~~~~~ In the name of God, Amen, I JOEL NEWSOM of the County of Wayne and State of North Carolina being in a low state of health, but in sound mind and memory, do make and ordain this to be my last will and testament, as follows - (viz) ITEM 1ST, I give and bequeath unto my son LARRY NEWSOM, all my lands lying on the south side of Black Creek, (viz) The lands whereon I formerly lived, the lands whereon Sally Daniel now lives, and also the lands I purchased of Willis Garner and also a tract of piney land adjoining the tract I bought of Willis Garner. I also give and bequeath unto my son LARRY NEWSOM, four negroes (viz) Harry, Allen, Ben and Tom to him and his heirs forever. I also give unto my son LARRY NEWSOM, three horses, (viz) the gray horse known as his horse at this time, the oldest bay stud horse, and the Sorrel Stud Colt. I also give to my son LARRY NEWSOM, two cows and calves, and two steers, one red and the other pided, also two pots, one spider, one brandy still, (called the King Still) two feather beds, and furniture, two bed steads, (one a curtain stead) three sows and pigs, also one half my stock of sheep, also a sufficiency of corn and fodder to serve him for one full year, also one writing desk, to him and his heirs forever. ITEM 2ND, I lend unto my daughter, ZILPHA DANIEL and my Son in law, JAS. DANIEL, my lands I bought of Elisha Daniel, lying between Black Creek and Contentnea Creek, with the exception of the fruit that may grow in the orchard on said land, until my Grand Son LARRY DANIEL, Son of JAS. & ZILPHA DANIEL arrives to the age of twenty one years, I also lend unto my daughter ZILPHA DANIEL one negro girl named Hanner during her lifetime. Which I then give unto the heirs of my daughter ZILPHA DANIEL lawfully begotten of her body, the said negro girl Hanner, together with her increase. I give unto my daughter ZILPHA DANIEL the lawful interest of one thousand dollars which is to be paid to her yearly after my death, during her natural life, which thousand dollars, I wish placed in the hands of my Son LARRY NEWSOM and him to pay over the interest as above stated, and after the death of my daugh-ter ZILPHA DANIEL, I give the above named sum of one thousand dollars to her heirs lawfully begotten of her body. I also give unto my daughter ZILPHA DANIEL one Sorrel Mare six years old, two cows, one black the other the Elisha Daniel cow, one sow and pigs. ITEM 3RD, I give and bequeath unto my son JAMES NEWSOM my tract of land whereon I now live lying on the north side of Black Creek also three negro boys, (viz) Tony, Will and Sam, also one brandy Still, (called the Cook Still) one blue chest, one beaufat, one rifle gun, two pots, one pan one spider and one skillet, two feather beds and furniture, two bed steads, (one a curtain stead) also I give my son JAMES NEWSOM two horses, the gray horse called the Martin horse and the bay Stud four years old, one bridle and saddle, one yoke of oxen, two cows and calves, two heifers, three sows and pigs and one half of my stock of Sheep, two weeding hoes, two dozzon (sic) plows, two plow hoes, two plow frames, and gear, two grubbin hoes, one cart and cart wheels, and a sufficiency of corn and fodder to serve him and his stock for one full year. Also fifteen hundred pounds of fat pork. I also give him the fruit that may grow in the Elisha Daniel orchard, until my grand Son LARRY DANIEL shall arive to the age of twenty one years, to him and his heirs forever. ITEM 4TH, I give and bequeath unto my sister CHRISTIAN EVANS one hundred dollars to her and her heirs forever. ITEM 5TH, I give and bequeath unto my sister PATIENCE PEARCE a negro girl by the name of Dile, to her and her heirs forever. ITEM 6TH, I give and bequeath to my sister SALLY HOWELL (if living) one hundred dollars, and if dead I wish it to remain in my estate. ITEM 7TH, I also give and bequeath unto my son LARRY NEWSOM two hundred and fifty dollars and twenty five cents, also one cart and wheels two dozzon plows and plow frames, two jars, two plow hoes, two weed-ing hoes, two grubbing hoes, also eighteen hundred pounds fat pork, also one case of razors and strap and shaving box to him and his heirs forever. ITEM 8TH, I give and bequeath unto my grand Son LARRY DANIEL a tract of land lying in the fork of Black Creek and Contentnea which is loaned to my daughter ZILPHA DANIEL and my Son in law JAS. DANIEL which is the lower lot I bought of Elisha Daniel, which he is to have when he arrives to the age of twenty one years to him and his heirs forever. ITEM 9TH, I give and bequeath unto my grand Son JOSEPH DANIEL a tract of land which is loaned to my daughter ZILPHA DANIEL and my Son in law JAS.DANIEL which is the upper lot I bought of Elisha Daniel, and where the said E. Daniel lived, which he is to have when my grand Son LARRY DANIEL arrives to the age of twenty one years to him and his heirs forever. ITEM 10TH, Its my will and desire that all my property not heretofore disposed of shall be sold, and my just debts paid, and after paying the above legacies the residue of my estate not yet disposed of, to be equally divided between my two sons LARRY NEWSOM and JAS. NEWSOM. I hereby appoint and nominate my worthy friend, THEO SIMMS and my Son LARRY NEWSOM my hole and sole Executors, to this my last will and Testament.
