Wayne County, NC - Will of Elizabeth Pate, 1885 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~ In the name of God Amen I ELIZABETH PATE of the County of Wayne and State of North Carolina being in good health of body and of sound mind memory and understanding but mindful of the uncertainty of my earthly existence do make this my last will and testament in manner and form following. Item 1 I do hereby desire that my executor to be hereafter named shall provide for my body a decent burial suitable to the wishes of my relations and friends and pay all funeral expenses and last debts out of the monies that shall first come into his hands as part of my estate. Item 2 It is further my will and desire that all the personal and real estate of which I shall die seized and possessed shall be equally divided between my children herein named. That is to say my son MCDONALD PATE, PATSY ROUSE,wife of WILLIAM J ROUSE, CORA PATE, ARKANSAS PATE, BRYAN PATE and FRANCIS MARION PATE, these children having never received from myself nor from their father, MAJOR I PATE, during his lifetime any portion of our personal real estate. Item 3 It is further my will and desire that the portion above bequeathed and devised to PATSY ROUSE , wife of WM. J ROUSE, shall after her death descend and be given to her two children, CHARLEY and STEPHEN ROUSE and if these children die without heirs of their bodies then the property shall revert to the heirs mentioned in Item 2 to be divided as the law in such cases provides. Item 4 I hereby constitute and appoint my beloved son McDONALD PATE guardian to such of my children above named as shall not have arrived at manhood or womanhood at the time of my death. Item 5 I give and bequeath to my children by my first husband, WRIGHT LANGSTON, to wit ALPHA ANN BEST, wife of BENJAMIN BEST, CLARISSA JOYNER, wife of EVRITT JOYNER JR, and JOHN LANGSTON five dollars each in money, they having already received all the property to which they were entitled from their fathers estate. Item 6 And lastly I do hereby constitute and appoint my beloved son McDONALD PATE my lawful executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same, hereby revoking and declaring null and utterly void all other wills and testaments by me heretofore made.
