Pate, Jr. WILL OF JOSEPH PATE (1847) OF WAYNE COUNTY, NORTH CAROLINA In the name of god Amen. I, Joseph Pate, of the County of Wayne and the State of North Carolina being of Sound and perfect mind and memory, blessed be god, do this 6th day of July in the year of our Lord one thousand Eight hundred and Forty Seven make and publish this my last will and testament in maner [sic] following that is to Say, 1st, I lend to my wife Elizabeth Pate durin [sic] her naturel [sic] life or widowhood all the land and plantation I own lying on the north Side of Stoney Creek Swamp up to the upper line also I lend to my wife Elizabeth Pate during her life or widowhood all my household and kicking furnature [sic] of every description and both of my Carts and my Still all of my barrels and Corks of every discription [sic] two horses Monk and lyd all of my Stock of Cattle hogs and fowls of Every descrition all of my working tools farming [utensils?] of Every description all of my bee hives also all of my Stock Sheep and grind Stone. Item 2nd, I give to my wife Elizabeth Pate fifty dollars in money and all of my bacon porke [sic] Lard Corn fodder Cotten pees and potatoes and flax. Item 3rd, I give to my son Thorogood Pate Eighty acres of land where he now [lives?] to [beldid?] of on the lower part of my land on the South Side of Stoney Creek Swamp to be lode of So as to run from the Said Swamp out to the back line to he and his heirs forever. also I give him one horse that he has now in his [posession?]. Item 4th, I give to my son James E. Pate to he and his heirs forever Eighty acres of land lying on the South Side of Stoney Creek Swamp Joining Thorogood pates Line to begin in Said Swamp at an old Crosway in Said Swamp near the upper End of the plantation that lies on the South Side of Said Swamp and to run out So to the back line So as to make Eighty acres. Item 5th, I give to my Son Elijah Temples Pate Eighty acres of land Lying on the north Side of Stoney Creeks where I now live Joining Bryan H. Pates land to begin in Said Swamp on the mouth of the first small branch above the house and run out to the back line So as to make Eighty acres. ... Pates upper corner in Said Swamp and runs out to the back line So as to make Eighty acres. Item 7th, I give to my Son Joseph Pate all the land on both Sides of Said Swamp that I own that I have not willed away to he and his heirs forever also I give to my Son Joseph Pate one bay colt named [illegible]. Item 8th, I give to my daughter Annamiasah Scott twenty five dollars in money. Item 9th, I give to all of my Daughters Susana Pate, Eliza Pate, Barbary Pate, Charlotte Pate and Polly Pate one feather bed and firnature [sic] a peace [sic] after my death and my wife Elizabeth Pate decd. also I give to my five last mentioned daughters all of my money and notes that is not willed away before to Equally Divided between them after my [covered over, probably "debts are"] paid. also I give them all the rest of my property that [covered over] my wife Elizabeth Pate that is not otherwise willed away to be sold and Equally Divided between them after my Decd and my wife Elizabeth Pate Decd. and hereby make and ordain my friends Bryan H. Pate and James E. Pate Executors of this my last will and testament in witness whereof I the Said Joseph Pate have to this my last will and testament set my hand and seal the day and year above written.
