(Chip) Pate, Jr. Recorded November 1854 I Shadrick Pate of the County of Wayne and the State of North Carolina, being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following, that is to say, First that my executor here inafter named shall provide for my body a decent burial acceptible to the wishes of my relations and friends and pay all funeral expenses together with my just debts howsoever and to whomsoever owing out of the money that may first come into his hands as part or parcel of my estate. Item. I give and devise to my son Ezekiel thirty eight and three quater acres of land that he now lives on joining the land of Jackson [?] Langston to have and to hold to him and his heirs in fee simple forever. Item. I give and devise to my son Gastin thirty eight and three quarter acres of land joining Adam Langston to have and to hold to him and his heirs in fee simple forever. Item. I give and devise to my son John thrity eight and three quarters acres of land tha he now lives on joining the land belonging to the heirs of John W sapor [?] to have and to hold to him and his heirs in fee simple forever. Item. I give and devise to my son Thomas thirty eight and three quarter acres of land that I now live on one bed and furniture. My will and desire is that if he does not live to have any heir that his part be sold and equally divided between my four girls [illegible] here except my wife life estate on the A. Bowen [?] named [?] land. Item. I give my wife one [smudged] and all of the household furniture and everything as it now stands her lifetime and after her death my desire is that what she leaves be sold and divided between the girls. And lastly I do hereby constitute and appoint my son Jno R. Pate my lawful executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause there of here by invoking and declaring utterly void all other wills and testaments by me here tofore made. In witness where of I the said Shadrick Pate here unto set my hand and seal this the 6th day of November 1854. Shadrick [middle initial illegible] Pate (signed) Since sealed, published and declared by the said Shadrick Pate to be his last will and testament in the presenece of us who at his request and in his presence do subscribe our names thereto. Term 1854 The foregoing paper writing purporting to be the last will and testament of Shadrack Pate, deceased, is executed for filing in open court by John R. Pate the executor therein named, and the due execution thereof by the said Shadrack Pate is proved by the [illegible] and examination of Thomas Howell and DeWitt C. Pate, the subscribing witnesses thereto. It is the [illegible] considered by teh court that the said paper existing is the last will and testament of the said Shadrack Pate, and the same is ordered to be received and filed. And therefore the said John R. Pate, executor as aforesaid, duly qualified as such by taking the oath requred by law. Benj.
