Wayne County, NC - Will of PATE, Lewis 1864 File contributed for use in USGenWeb Archives by William S. Pate, Jr. WILL OF LEWIS PATE OF WAYNE COUNTY, NORTH CAROLINA (1864) In the name of God amen. I Lewis Pate of the County of Wayne and State of N. Carolina being of sound and perfect mind and memory (blessed be God) do this twenty-fourth day of July in the year of our lord eighteen hundred and Fourty Six make and publish this my last will and testament in the manner following - viz - I lend to my wife Betsy during her natural lifetime All the land and plantation where on I now live except the field over the Branch. Also one third of the piney woods which I bought of Hardy Pope and it to be divided the long way the last parte to be hers one young mare [called?] Lightfoot two cows her choice all my corn fodder bacon larde soap and wheete that I now have on hand two sows and pigs all my house holde and kitchen furniture except two beads and beadsteads and Furniture also one flax which I also lend her my farming tools one carte wheels and gear. The shoe leather on hand one grindstone stone the poultry of every description. All the spinning wheels and cards one loom and gear all my cotton and wool on hand one side saddle and bridle. Item, I give to my daughter Letty one bead and stead and furniture already received by her and seven acrs of land whereon her house stands it to be taken off of the land I bought of William Thompson. Item, I give my daughter Penelopy one bead beadstead and furniture already received by her also four acres of land on which her old house stands it taken from the land I bought of Hardy Pope. Item, I give to my daughter Betsy one bead and beadstead and furniture Also I lende to her one half of my old place field during her natural life it divide north and south the western part to be hers. Item, I give to my daughter Seny four acres of land which I have leased to her husband Calvin Pate Also one bead beadstead and furniture received by her. Item, I give unto my son Elijah after the death of my wife all the lands and property of every description that I have lente her to him and his heirs forever. Item, I give to Stephen Pate my oldest son the lot of land where he now lives which I bought of Wright Langston also one field none [known?] by the name of the pond branch field and all the land which I bought of William Thompson not heretofore given away. Item, I give to my son Wileby the east part of the olde place field on which he now lives also the west parte of said field after the death of my daughter Betsy to home [whom?] I have lent it during her natural life also one third of the tract of piny woods land which I bought of Hardy Pope divided the long way the weste side to be his. Item, I give to my son Bryant one bead beadstead and furniture also one field none [known?] by the name of the olde rie field joining the widow Garners also one other field none by the name of pungo field in ended [?] as the fence now stands. also the balance of the piny woods tract of land which I bought of Hardy Pope not heretofore given away. Item, I give to my grandson William Pate sone of William Pate deseast one shot gun. And it is my will and desire that the field over the branch together with all the reste of my property not heretofore given away be sold and all my just debts paid out of the money arising from sales of said property the balance of money after paying my debts if any go to my son Wileby And I hereby make and ordain my worthy friend Shadrach Pate Executor of this my last will and testiment In writing whereof I the said Lewis Pate have hereunto set my hand and affiswced my seal day and year above written. his Lewis X Pate (seal) mark Signed sealed in presence of us Jno Smith James [?] Gardner I desire that the following be taken as a part of my will - viz - that my will shall speak as of the time of my death. I desire the balance of my property on hand at my death sold and my just debts and the expenses of settling my estate paid out of the proceeds and out of such claims [?] as may be due me and the balance if any I give to my son Willoughby. In writing whereof I have hereunto set my hand and seal this 27th day of August, 1852. his Lewis X Pate mark Witnessd - Josiah Howell Fr. Edmundson I desire the following to be taken as part of my will - viz - the property which I have given in my will to my son Bryant and who my bay mare named [unreadable] - I give in stead to my son, Elijah Pate, to hold [unreadable] for the benefit of my son Bryant during his life - and on his death to convey the same to the issue of said Bryant if he should marry and leave any and if he has no issue to belong to my son Elijah Pate. In witness whereof I have hereunto set my hand and seal this 6th day of March 1868. his Lewis X Pate mark Wayne County Court May term 1864 The last will and testament of Lewis Pate Deceased, also a codicil (unreadable) dated August 27th 1852, also another codicil dated March 6th 1858, as duly proven in (unreadable) form and Shadrach Pate the Executor therein named is qualified as such upon entering into bond, in the sum of eight thousand dollars with Willoughby Pate [rest unreadable] (signed) S.
