Wayne County, NC – Will of Starling Powell, 1813 ~~~~~~~~~~~~~~~~~~~~~~ Last Will & Testament of Starling POWELL, Wayne Co., NC., transcribed by Jan Lawson. Will of Starling POWELL, Recorded February Court 1803. In the name of God Amen I Starling POWELL of Wayne County being of sound and perfect Mind and Memory before God do this 22nd day of November in the year of our Lord One Thousand Eight hundred and two make and publish this my last will and testament in manner following, that is to say: Firstly I give and bequeath to my loving Friends Jesse SLOCUMB and Lewis SLOCUMB to have and hold the plantation know by the name of the Turner plantation and all my lands adjoining the same supposed to be Seven hundred acres more or less and two Cows & Calves each also to Susannah SLOCUMB One Dark bay Mare with a blaze face, and also to Jesse SLOCUMB two Sows & Pigs to be Chosen by him and five barrels of Corn. Secondly I give and bequeath to my loving friend Ezekiel SLOCUMB Four head of Stolled Cattle. Thirdly I lend unto the Negroes now in my possession namely Charles, Sam, Phillis and Tom & York & Harry and their increase the Plantation on the South side of Thunder Swamp and North side of Goshen known by the names of the Mar___ Plantation and the Goshen place and the said Charles, Sam, Phillis & Tom to have One Sow & pigs and One Cow & Calf each and One Yoke of Oxen and the Sorrel Mare and Bale horse to be to use of the whole of them and Corn and other Provisions Enough to support them One year and One third of the Wheat and Rye that’s now growing on my Plantation to be layed off to them by my Executors. My will is further that the said Negroes and the property being willed to them be under the Care and Direction of my Executors and William FLOWERS until each one shall arrive to the age of twenty one years, and then to do and act as they themselves shall think proper. I also give to the said Charles, Sam, Phillis and Tom two feather beds and furniture and the Plantation tools Cart & all the household and _______ not otherwise devised _____ and Charles all my wearing apparel. Fourthly I Give and bequeath to my Brother Thomas POWELL One feather bed and furniture to be his choice and one Mare Called the black Mare and her Colt and two hundred Dollars in Cash. Fifthly I Give and bequeath to my friend Joel HERRING One hundred Dollars in Cash. Sixthly I Give and bequeath to by brother Ristore POWELL One hundred Dollars in Cash. Seventhly I give and bequeath to my friend Robert FLOWERS One hundred and fifty Dollars in Cash. Eighthly I give and bequeath to my friend Joseph DICKENSON One hundred Dollars in Cash. Ninthly I give & bequeath to my friend William FLOWERS One hundred Dollars in Cash. Tenthly I give and bequeath to my friend Jesse GULEY One hundred Dollars Cash. Lastly I Give and bequeath to my Brothers Charles POWELL, Douglas POWELL and Nicholas POWELL One Dollar each and to the heirs of Edith FLOWERS, dec’d Wife of Simon FLOWERS One dollar and to the heirs of Ruth HARRELL dec’d Wife of Elisha HARRELL One dollar. My Will is further that the whole of my property both real and personal not herein before disposed of by my Executors _________ overplus shall remain after paying my debts and legacies before mentioned to be disposed as my Executors think proper. And I hereby make and Ordain my Worthy friends Robert FELLOW, Senr., Ezekiel SLOCUMB & Jesse SLOCUMB Executors to this my last Will & Testament. In Witness whereof I the said Starling POWELL have to this my last Will and Testament set my hand and seal the day and year above Written. Signed: Sterling POWELL (seal). Signed sealed published and declared by the said Starling POWELL as his last will and testament in the presence of us who were present at the time of Signing and Sealing thereof. Note: Interlincation made and acknowledged and the 66th & 67th lines canceled and part of the 57th by the same Starling POWELL the testator in presence of Lovett REAVES, Isaac GIDDENS and Lee REAVES. Interlincation (insertion of line between lines) involved the insertion of the name of William FLOWERS included with Executors in the care and direction of the Negroes and the property bequeathed them; b.) 66th & 67th lines stricken and canceled read as follows: My Will is further that my Executors hire out my Negro man York at their discretion and apply the money for the hire of the said Negro as they think fit; c.) canceled portion of 57th line illegible].
