Pierce "I ETHELDRED SAULS of the County of Wayne, North Carolina, being of sound mind & memory, but feeling conscious of the uncertainty of life, do make, constitute and declare this to be my last will & testament in manner & form as follows. First, that my executor shall have my body suitably & decently buried, and shall pay my funeral expenses and all my just debts, out of the first monies ensuing from my estate. Second, I give and bequeath to my beloved wife PENELOPE SAULS, one negro man named John, five beds, bedsteads & furniture, one bureau, one centre-table, two & a half dozen silver spoons, one half dozen sitting chairs, one small folding table, one woolen wheel and pair cards, one sorrel mare & buggy, one thousand pounds of pork, forty barrels of corn, four choice stocks of fodder, fifty pounds of sugar, thirty pounds coffee, one large trunk, one choice com_ calf, one sow & pigs (her choice) also for life one negro woman named Mary, --- and after the death of my wife, it is my wish that my executor sell said negro woman Mary and divide the proceeeds among my four children, L. J. SAULS, MARY L. SAULS, ELIZABETH E. BECTON & CAROLINE F. JENKINS. Third I give & bequeath to my daughter MARY L. SAULS the following negroes: negro man Primus, negro boy George, Celia, Lucy and Mary Eliza to have & to hold absolutely. Fourth, I give & bequeath to my son LAWRENCE J. SAULS negro boy Patrick and negro girl Jane. _ also I give & devise to my said son L. J. SAULS & his heirs, the tract or parcel of Land bounded as follows, beginning at a stake on the run of Nahunta Swamp thence North 26 1/2 (degrees) East 164 poles to a forked post white oak thence North 2 (degrees) W 71 poles to a stake on the run of the round Meadow branch, the corner of Clarkey Martin's dosser(?) thence down the meanders of said branch to a water oak on said run, thence North 6(?) East 317 poles to a pine, thence North 61 poles to a water oak on a watery branch, thence up the various courses of said branch as it meanders to a stake in the road leading from Sauls cross-roads to Nahunta Depot, thence South 26 (degrees) East 30 poles to a pine, thence South 22 West 65 1/2 poles to a small post oak in Eth Sauls line, thence West 75 1/2 poles to a maple on the run of the North West prong of the Meadow branch, thence down the meanders of said branch to a stake, thence South 50 (degrees) East 18 poles to a persimmon tree, thence South 25 (degrees) West 10 poles to a black-gum (down) on the run, thence down the meanders of the same to a white oak the dividing corner between said Sauls & Eth Yelverton, thence N 1 1/2 (degrees) W 27 1/2 poles to a stake, thence N 71 (degrees) East 22 poles to a stake, thence N 14 1/2 (degrees) East 130 poles to a stake, thence N 32 1/2 East 35 1/4 poles to a white oak on the east side of the round Meadow branch, thence South to the main run of Nahunta Swamp, thence down the same as it meanders to the beginning, containing 350 acres more or less. Fifth, I give & bequeath to CAROLINE F. JENKINS negro boy Shepherd and negro girl named Ferris (?) also _ hitely (?) _ also, during her natural life, the following negroes Jesse, Wright, Mary their child Tom; and should my said daughter leave children at her death, then I give & bequeath said slaves, Jesse, Wright, Mary & Tom to said children (grandchildren to stand in the place of & represent a deceased child or children), but should the said CAROLINE F. JENKINS die leaving no child nor the issue of a deceased child, living at her death then I give & bequeath the said four negroes to my children L. J. SAULS, E. E. BECTON and MARY L. SAULS. Sixth, I give & bequeath to my son LAWRENCE J. SAULS negroes Charles, Dobbin, Emily & Haywood in trust for the use & benefit of my daughter ELIZABETH E. BECTON, free from the control or influence of her husband, to be under the sole control of said daughter, with full power on her part to dispose of the same by deed, will or other-wise _ and should she die without disposing of said slaves, then I give & bequeath them to her children (grandchildren to stand in the place of & represent a deceased child or children) but should the said ELIZABETH die leaving no child nor the issue of a deceased child, living at her death, not having disposed of said slaves, then I give & bequeath them to my children L. J. SAULS, E. E. BECTON & MARY L. SAULS. Seventh, It is my will that my executor sell all my estate both real & personal, undisposed of and after paying my debts & legacies the remainder to be divided equally between my children L. J. SAULS, MARY L. SAULS, C. F. JENKINS and E. E. BECTON. Eighth, It is my will that my son LAWRENCE J. SAULS pay out of his own individual property the note I owe Benjamin Simms Sr as a condition precedent to his receiving the bequest & devises herein contained. Nineth, I hereby constitute & appoint my son LAWRENCE J. SAULS my executor, to carry out in its true intent & meaning this my last will. In testimony whereof I hereunto set my hand & seal this the 17 day of October AD 1859 in the presence of the subscribing witnesses who witness this as my will, at my request & in my presence. Caho (ETHELDRED SAULS Will Recorded Nov Co 1859) A paper writing purporting to be the last will and testament of Ethedred Sauls dec'd is exhibited for probate in open Court by L. J. Sauls the executor therein named and the due executrix thereof by the said Eth Sauls is proved by the oath and examination of C. C. Peacock & J. M. Caho the subscribing witnesses thereto. It is therefore considered by the Court, that the said paper writing and every part thereof is the last will & testament of the said Eth Sauls and the same is ordered to be recorded & filed.
