Wayne County, NC - Will of John Sherard Senr., 1823 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ In the name of God Amen I JOHN SHERARD SENR. of the County of Wayne and State of N Carolina being in perfect health and a of sound mind and memory Calling to mind the Mortality of my Body knowing that it is appointed for men to die and for the better setting of my worldly estate do make and publish this my last will in manner and form following Viz ITEM I give and bequeath unto my daughter MARY C. HANDLEY Seven Negroes Primus, Phillis, Susanna, Rachel, Teldy, Sampson, son of Phillis and Lewis which she has received into her possession also one horse, bridle and Saddle Two cows and calves six head of sheep one bed and furniture already received unto her possession ITEM I give to my grand son JONATHAN S. BRANTLY two Negroes Rubin and Sely if he lives until he is twenty one years old if not to be equally divided amongst my daughter MARY C. HANDLEY'S children them and their increase ITEM I give and bequeath unto my son GABRIEL a certain tract and parcel of land on the North Side of Nauhunty Swamp and described as follows (gives description, mentions Grandvilles line) To have and to hold all my lands west of the above named bounds containing by estimation five hundred acres more or less To him his Heirs and assigns forever Also seven Negroes Bele, Sampson, son of Lucky, Fanny, Jr, Alvin, Rose and after the death of my wife ________ them and their increase forever one horse bridle and Saddle Two cows and calves Six head of Sheep one bed and furniture also my blacksmith tools at the death of my wife ITEM I give and bequeath to my son JOHN H. a certain part and parcel of my plantation and lands lying below Sherards Branch and up the west prong of said Branch to the path that leads to the Parker place and then with the said path to the back line to him his heirs and assigns forever also seven Negroes Lewis, son of Lucky, Duplin, Selvy, Exum, Mary, Penny and after the death of my wife negro John them and their increase forever one horse bridle and Saddle Two cows and calves Six head of Sheep one bed and furniture and also I desire he should have the use and benefit of half my Still and orchard during the life of my wife and after her death for him to have the whole of both ITEM I give and bequeath unto my daughter DOROTHY H. one bed and furniture already rec'd one cow and calf and Twenty dollars ITEM I lend my wife DOROTHY SHERARD the remainder part of my plan- tation and one half the use of my Still and orchard with all the lands there unto belonging which I have not given heretofore during her natural life And after her death to my Son JOHN H. his heirs and assigns forever I also lend my wife during her life the following Negroes Lee, Old Sely, Harry, Lucky, John, Jupiter, Cloa, Virgil, Sidney, Phillip, Davy, Tom, Richard, Soloman, Sharlet, Nelson, Persy, Smithy, Roday, Olif, Tegua and Chana Its also my will and desire that the last seven named negroes Viz Sharlot, Nelson, Persey, Smithy, Rody, Olif and Tegua should be at the discretion of my wife to dispose of as she thinks proper but if not disposed by her its my will and desire that they should be sold by my Executors on a credit of twelve months and the arising from such Sales to remain in their hands by their paying to my daughter DOROTHY H. the lawful interest yearly applied for by her during her natural life and after her death the principle to go to her children if any arrives to the age of twenty one years if not its my desire for it to be equally divided among my children and Grand children. I also give to my grand Daughter DOROTHY H. HANDLEY after the death of my wife one Negro Girl by the name of Chana her and her increase and I give after the death of my wife to my grand Son GABRIEL L. HANDLEY one negro boy by the name of Davy I give after the death of my wife to my grand son JOHN HANDLEY one negro boy by the name of Richard Its also my will and desire after the death of my wife that Cloa, Virgil, Sidney, Phillip, Tom, Soloman and their increase should be equally divided between my two Sons GABRIEL and JOHN H. I also lend my wife after all my Just debts is paid all the remainder part of my property which has not heretofore been given during her natural life and at her death to be sold by my executors and the money to remain in their hands by their paying my daughter DOROTHY H. the lawful interest yearly if applied for by her during her natural life and after her death the principle to go to her children if any arrives to the age of twenty one years if not its my desire for it to be equally divided among my children and grand children. And I hereby make and ordain my two Sons GABRIEL and JOHN H. SHERARD my executors of this my last will and testament in witness whereof I the said JOHN SHERARD SEN. have to this my Last will and Testament set my hand and seal.
