Wayne County, NC - Will of Benjamin Sherrod, 1826 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ In the name of God Amen I BENJAMIN SHERROD of the State of North Carolina Wayne County of perfect mind and memory thanks be given unto God Calling unto mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my Last will and testament In the following manner ITEM 1ST I lend to my Beloved wife POLLEY SHERROD During her widow- hood part of the ROBERT SHERROD plantation the orchard field the Canoe Landing field the baby New ground field the the Ned ? field the big field over the branch below the house the hole of the young orchard field the houses and plantation where I now live between the Tussacy Branch and Jeffreys Branch my wish and desire is that my wife have have the privilege of the hole of my lands to get timber fire wood feed hogs and Clear if She sees fit ITEM 2ND I give and bequeath to my wife POLLEY SHERROD fourteen Negroes by the names of Rose, Little Henry, Nancy, Jordan, Evret, Lizza, David, Lucy, Emma, Offie, Elisha, Nathan, Zilpha, Mark and also four feather beds steds and (two sentences that I can't read, then nearly a whole page of household items to his wife) ITEM 3RD I Lend to my Daughter PATIENCE REVILLE During her natural Life five Negroes by the Names of Old James, Selah, Claracy, Cate and Lige and their Increase one half of a tract of Land Containing three hund-red and eighty acres in Wayne County joining Preaching JOHN HOWELL'S Land and after her Death I give and bequeath to the Children of PATIENCE REVILLE the before Named five Negroes and their increase and the said above Named one half of a tract of Land to be Equally Divided among her Children then Living Share and Share a like ITEM 4TH I give to my Daughter PATIENCE REVILLE one feather Bed Sted cord and furniture ITEM 5TH I give and Bequeath to my Son HENRY SHERROD all my Lands Lying on the South Side of the Slew Swamp it being the Land where RALPH FLETCHER and HENRY SMITH formerly Lived also five Negroes by the Names of Old Jacob, Pat, Isaac, Big Henry, Young Jacob also one feather Bed and furniture Sted and Cord ITEM 6TH I Lend unto my Daughter NANCY WARD all the Land Lying on the South Side of the poplar branch that I purchased of THOMAS PERSON During her Natural Life and at her Death I give the said Land to her Children then Living also I Lend her five Negroes by the Names of Hanner, Jack, Rodah, Avah and Angy and their Increase to my Daughter NANCY WARD During her Natural Life and at her Death I give the said Negroes and their Increase to her Children then Living ITEM 7TH I give and Bequeath to my Son WILLIAM SHERROD all the Land that I purchased of THOMAS PERSON Lyeing on the North Side of the poplar branch and South Side of Nahuntah Containing on or about five hundred acres and also the East part of my Old home tract or patent of Land Lyeing on the East Side of the Tussacy Branch and the ROBERT SHERROD tract of Land Lyeing on the South Side of Nahuntah Swamp also it is my will and Desire that my Son WILLIAM SHERROD Should take possession of all the before mentioned tracts or parcels of Lands at my Death Except the part of said Land that I Lent to my wife During her widowhood also I give and be-queath to my Son WILLIAM SHERROD Nine Negroes by the Names of Young James, Old Peter, ____ Peter, Patience, Phillip, Pearcy, Wiley, Sam and Harris ITEM 8TH I lend to my Daughter SMITHA BEST one half of a tract of Land Lyeing in Wayne County and joining Preaching JOHN HOWELL'S Lands Containing three hundred and eighty acres During her Natural Life and at her Death I give the said part of the said tract of Land to her Children then Living I also Lend my Daughter SMITHA BEST Six Negroes by the Names of Fan, Cherry, Haywood, Sall, Rheuben, Charlot and their Increase from this time During her Natural Life and at her Death I give the above Named Negroes and their Increase to her Children then Living ITEM 9TH I give and Bequeath to my Grandson BENJAMIN SHERROD part of my home tract of Land Beginning in the mouth of the Tussacy Branch and runs up said Branch to the head thence a straight line the course of the said Branch to the back line of my Old Patent then up said Old Patent line near a ____ course to a Black Gumb Corner thence with said Patent Line to the Slew Swamp then down said Slew Swamp to the beginning ITEM 10TH Also my will and desire is that all the property that I have not given away should be sold by my Executors and Equally divided Between my wife POLLEY SHERROD and my five Children PATIENCE REVILLE, HENRY SHERROD, NANCY WARD, WILLIAM SHERROD and SMITHA BEST and also all the money that I have at the time of my Death be Equally divided except one hundred dollars in Silver which I have given to my wife and all the money that is owing to me to be Equally Divided Between my wife POLLEY SHERROD and my five above mentioned Children ITEM 11TH I do hereby constitute and appoint my Son WILLIAM SHERROD and my Brother WILLIAM SHERROD my hole and sole Executors of this my Last Will and Testament I do hereby utterly Revoke and Disanull all and every other will and testament Ratifying this and no other to be my Last Will and Testament in witness hereof (sentence that I can't read) Day of August 1825 asigned and Sealed _____ SHERROD Seal in presents of us JOHN WASDIN DAVID WASDIN Probate February Term 1826 Wills 1776-1927 CR 103.801.15 Folder 1826 Benjamin Sherrod NC State Archives, Raleigh, NC ______________________________________________________________________ Copyright.
