Wayne County, NC - Will of Rachel Smith, 1837 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~ In the name of God Amen I RACHEL SMITH of the county of Wayne in the state of North Carolina, being of sound mind and perfect memory, but knowing that all persons once must die, do make this my last will and testament in manner and form following. Viz ITEM 1ST I desire that my hereinafter named executor, after my death, expose to a sale on a credit of six months all and every part or particle of my estate and after paying all my just debts and all necessary expenses of my burial. I give of the money arising from said sale unto my beloved son SANDERS SMITH one hundred dollars. I also give of the money arising from said sale unto my grand daughter CATHERINE HOWELL one hundred dollars. The residue of money arising from said sale, I wish equally divided among all the lawful heirs of my body, my son SANDERS SMITH and my grand daughter CATHERINE HOWELL sharing equally with the others, except my son THEOPHILUS SMITH, him I give one dollar and the proportionable part which he would draw, I wish equally divided among all the lawful heirs of his body. ITEM 2ND I nominate and appoint my friend WILLIS PEAL my sole executor to this my last will and testament utterly revoking and forever disannuling all other wills or wills by me heretofore made. In witness whereof I have hereunto set my hand and seal this fifteenth day of September in the year of our Lord one thousand eight hundred and thirty six.
