Wayne County, NC - Will of William Smith, 1832 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~ In the name of God Amen, I WILLIAM SMITH of the county of Wayne and state of North Carolina do make ordain and publish this instrument as my last will and testament. FIRST I lend unto my beloved wife, RACHEL, all my land on this side of the branch where I now live bounded as follows beginning down in the mouth of the said branch at the run of the swamp then up the branch with the run to the road then with the road to Jesse Smith's line then with his line down to the run of said swamp then up the swamp with the run to the beginning also my orchard field on the branch also the liberty of the pine woods for timber and sauge during her life time also my negro man Tank and my negro man Asa and my negro woman Hester and my negro girl Charlotty also I give unto my beloved wife one crib of corn also I give her twenty five hundred weight of pork four sows and pigs six blade stacks also two of my choice horses two head of cattle ten head of sheep also my still twenty head of geese also my cart and wheels and all (one line didn't copy, something about farming tools) and kitchen furniture also as much cotton and flax as my executors may think proper for her. SECOND I lend unto my daughter, ZILPHA HAM, all the land whereon she now lives during her life, after her decease, I give said land to her heirs also my negro girl, Annie, I lend her during her life and then give said negro girl and her increase to her heirs. THIRD I give unto my son GILES SMITH the following tract of land beginning down at the mouth of the branch on the run of the swamp then up the run of said swamp to the line of Benjamin Sauls old place then with his line to the road then down the road to GILES corner then with the dividing line to THEOPHILUS SMITH branch then down the branch to the beginning also my negro man Hardy also I lend unto my son GILES all the cleared land on the side of the branch and my negro girl Franky until he is satisfied for being security for THEOPHILUS then I lend the land and negro to my daughter in law HOWEY SMITH during her life time or widowhood then I give said land and negro woman to her lawful heirs said negro hired and land rented to the highest bidder. FOURTH I lend unto my daughter in law HOWEY SMITH all the land whereon she now lives during her life time and at her decease I give it to her lawful heirs and also I give at her decease the said negro and her increase to her lawful heirs. To wit; beginning at the branch at the shop then up the branch to SALLY HANDLEY'S path then down the path to a forked pine corner near Tank's potato patch then down the road to the second stream then down the stream to the run of the said branch then with the run of the said branch to the beginning. FIFTH I give unto my son SANDERS SMITH my boy Bennet. SIXTH I give unto my daughter CAREN HAM a certain tract of piney woods land that I bought of Thimothy Mooring also I lend unto her my negro girl Mary and my negro man Hopton during her life time or widowhood and then I give them to her lawful heirs for them and their heirs forever. SEVENTH I lend unto my son ROBERT SMITH the long field and the three ____ and the fresh ground that he is now a taking in, out to THEOPHILUS SMITH'S line during my wife's life time after her decease then give it to him also the field over the road after the death of my wife and the piney wood land equally divided between my two sons ROBERT and WILLIAM SMITH and my daughter in law HOWEY SMITH also I give unto my son ROBERT eighteen barrels of corn two stacks of fodder three hundred weight of pork one feather bed and furniture one young mare bridle and saddle one sow and pigs one cow and calf two ewes and lambs also one negro boy called Sherman. EIGHTH Also I give unto my son WILLIAM SMITH all my land and plantation whereon I now live and my pocosen tract and one half of the piney woods tract between THEOPHILUS SMITH'S line and the back line of the land which I bought of John Hill to take possession of after the death of my wife also a negro girl named Wineford also I give him eighteen barrels of corn two stacks of fodder three hundred weight of pork one feather bed and furniture one young horse bridle and saddle one sow and pigs one cow and calf two ewes and lambs. My desire is that my son WILLIAM should have the use of the grave yard field and that field over the road as long as my wife lives. NINETH I lend unto my grand daughter CATHERINE HANDLEY after the death of my wife one negro girl Charlotty and one boy child called Nicholas if she should die without an heir lawfully begotten by her body for the same to be equally divided between my surviving children also one feather bed and furniture. My desire is that my man Bill should be as free as the law will allow him and live with who he pleases and be governed by them and my man Tank also after the death of my wife. My will and desire is that the balance of my property which I have not given away to be sold by my executors and applied to the payment and discharge of my debts. My desire is after all my just debts are paid the balance equally divided among my children. I constitute and appoint my worthy friends ELIJAH SMITH and WILLIS PEELLE JR. executors to this my last will and testament in witness whereof I have this eighth day of January in the year of our Lord one thousand eight hundred and thirty two signed my name and affixed my seal.
