Wayne County, NC - Will of Rufus Smith, 1890 ~~~~~~~~~~~~~~~~~~~~~~~~~~ I RUFUS SMITH of the County of Wayne and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and Testament in manner and form following. Viz: 1st That my Executors shall provide for my body a decent burial suitable to the wishes of my children and pay necessary expenses for burial and funeral also my just debts to whomever owing out of the first money coming into their hand as a part or parcel of my Estate. 2 I give and devise to my son N.J. SMITH the sum of one hundred dollars as his right and property forever. This is an addition to a valuable gift made in my lifetime. 3 I give and devise to my daughter SMITHY A. NEWSOME the sum of fifty dollars as her right and property. 4 I give and devise to my daughter MARTHA J. DAWSON the sum of one hundred dollars as her right and property forever. 5 I give and devise to my daughter SARAH J. PARRISH one tract of land adjoining the lands of R.A. Parks Ezekiel Smith & others containing one hundred acres also one sewing machine one cloths form (?) one bed and the necessary covering for it as her right and property forever. 6 I give and devise to my daughter J.A.R. (JULIA ANN REBECCA) ROUSE the sum of seven hundred dollars which sum is to be paid by my son GEO. H. in consideration of a valuable gift to him of the Old Homestead Plantation. Also I give her my bureau & one bed & necessary covering for it. 7 I give and devise to my son SIMPSON N. SMITH the sum of one hundred dollars his right and property. 8 I give and devise to my son GEO. H. SMITH the Homestead Plantation on which he now lives as his right and property forever provided that he pay over to J.A.R. ROUSE the sum of seven hundred dollars also ARRAH A. SMITH five hundred dollars (Total amount twelve hundred dollars.) Further I give my wagon to my son GEO. H. SMITH as his right and property. 9 I give and devise to my daughter ARRAH A. SMITH the sum of five hun- dred dollars to be paid by my son GEO. H. SMITH in consideration of a valuable gift of the Old Homestead Plantation on which he now lives. 10 It is my desire that my land near Goldsboro on the A. & N.C. R. Road containing seventeen and one half be sold at my death and proceeds equally devided and six of my heirs viz. N.J. SMITH MARTHA A. DAWSON S.N. SMITH SMITHY A. WOOD (Wood was her first husband) and ARRAH A. SMITH to have and to hold their own use forever. 11 It is my desire that my estate be allotted to my children as stated in the above items and if any residue it be equally divided among my children. 12 I constitute appoint my sons N.J. SMITH & GEO. H. SMITH my Executors to execute this my last Will and Testament in witness I RUFUS SMITH have set my hand and seal this tenth day of February in the year of our Lord one thousand eight hundred and ninety.
