Wayne County, NC - Will of Mark N. Smith, 1886 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ In the name of God Amen I MARK N. SMITH, of the County of Wayne and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following that is to say. FIRST That my executor hereinafter named Shall provide for my body a decent burial suitable to the wishes of my relatives and friends and pay all funeral expenses together with my Just debts, howsoever and to whomsoever, owing out of the money that may first come into his hands as a part or parcel of my estate. SECOND I consider the money that I paid for the land which my three sons, WILLIAM, AMAZIAH and JOHN GREEN bought in Lenoir County a full share for each of them in my estate. THIRD I give and devise to my daughter ZILPHIA F. UZZELL, wife of MAJOR UZZELL, one part of my land adjoining the lands of HENRY JOHNSON, BERRY A. PARKS and others (then gives description) FOURTH I give and devise to my daughter SARAH E. HILL, wife of JACOB F. HILL one part of my land adjoining the lands of HENRY JOHNSON and others (gives description of land, mentions Peters Branch, Bear Creek, R. A. Newsom corner & Berry A. Parks line) FIFTH I give and devise to my grand daughter, NICOLE ? GARDNER, daughter of SARAH GARDNER, one part of my land adjoining the lands of HENRY JOHNSON and others (then gives description) THIS WILL HAS TWO "FOURTH" FOURTH I enjoin upon my daughter SARAH E. SMITH to pay seven hundred and fifty dollars to be divided equal between all of my children, except my daughter MARY E. PARKS, wife of BERRY A. PARKS. The above was interlined before assigned. I give one bed and furniture to my daughter ZILPHIA F. UZZELL, in addition to what I have already given her. My will and desire is that my daughter SARAH E. HILL be allowed five years after my death to pay the seven hundred and fifty dollars also it is my will that all the residue of my estate, if any be sold and the money, together with my notes be divided equally between all of my children except MARY E. PARKS, after paying all of my debts and expenses of settling my estate, and lastly I do hereby constitute and appoint my trusty friend, JOHN I. HERRING, my lawful Executor to all intents and purposes to execute this my last will and testament, according to the true intent and mean- ing of the same, and every part and clause thereof, hereby utterly revoking and declaring all other wills by me heretofore made, utterably void and of no effect.
