Wayne County, NC - Will of Henry Smith, 1835 ~~~~~~~~~~~~~~~~~~~~~~~~~~~ In the name of God Amen I HENRY SMITH of The State of North Carolina and County of Wayne being Sick and Weak of body but of perfect mind and memory do make and ordain this to be my last Will and Testament 1st My will and desire is that all my Just debts be paid out of my Estate and after my Just debts is paid out of my Estate I give to my daughter WINNIFRED A. JORDAN fifty cents and no more I give to my grandson JAMES H. SMITH forty dollars which money my desire is should come out of my land I give all the remaining part of my land to my nine children hereafter named to them and their heirs forever to be equally divided between them (to wit) JAMES SMITH, JORDAN SMITH, SELAH SMITH, MATHEW SMITH, BURWELL SMITH, THOMAS A. SMITH, PRIER SMITH, CLARKEY SMITH and SALLY JOHNSON I give to my son JAMES SMITH one feather bed and furniture I give to my son THOMAS A. SMITH one feather bed and furniture I give to my daughter PRIER SMITH one feather bed and furniture and a Stand of Curtains I give to my daughter CLARKY SMITH one feather bed and furniture and a Stand of Curtains I give to my grand son JAMES H. SMITH one feather bed and furniture My will and desire is that if my grand son JAMES H. SMITH should die before he arrives to the age of twenty one years that the part that I have given him should be equally divided between my nine children that I have given my land to I give to my four children (to wit) JAMES, THOMAS, PRIER and CLARKY SMITH all the Corn fodder peas potatoes wheat rye Cotton bacon lard Soap all that I am in possession of at my Death I give to my two sons JAMES & THOMAS A. SMITH and my two daughters PRIER and CLARKY SMITH the whole of my crop that is either growing or standing on my plantation at my Death I also give to my four children JAMES, THOMAS, PRIER and CLARKY SMITH all the fattening hogs that I am in possession of at my Death I give to my daughter CLARKY SMITH one Chest I leave my Negro man Ben and all my Stock of horses Cattle Flock hogs sheep geese plantation tools household and kitchen furniture that I have not given away to be sold and for my daughter PRIER SMITH to have five dollars to buy her a chest and for the note that my son BURWELL SMITH gave to HENRY JOHNSON as administrator to the Estate of ALEX SMITH Dec'd paid out of the money and then for the remaining part of the money to be equally divided between my two sons and three daughters (to wit) MATHEW SMITH, THOMAS A.
