Wayne County, NC - Will of Thomas Smith, 1850 ~~~~~~~~~~~~~~~~~~~~~~~~~~~ In the name of God Amen I THOMAS SMITH of the County of Wayne and State of North Carolina being weak of body but of sound mind and Memory do make this my last will and testament My will is first that after my decease my body shall be decently buried then my Just debts paid SECOND My will is that my three sisters Viz WINAFORD, PRYER and CLARKY shall live together on my plantation and have free privilege the lands as I have myself so long as they remain together also to have everything as it now stands After their death my land shall be given to brother MATHEW and brother BURWELL SMITHS Children THIRD My will is that NANCY JANE SMITH, daughter of PRYER, JAMES HENRY SMITH, son of MATHEW and THOMAS SMITH, son of BURWELL SMITH, each have two hundred and fifty dollars after the death of my above named Sisters My will is that THOMAS SMITH son of BURWELL should have at my decease a forty dollar horse bridle and saddle, also my will is that my Negro man Ephram be equal divided between my three above named sisters WINAFORD, PRYER and CLARKY also my will is that ELIZABETH CROOM daughter of JORDAN SMITH should have one hundred and fifty dollars after the death of my above named sisters Also my will is that my above named sisters should have free privilege of Every thing as it now is Except either of them leave and stay off then she or they should not have any part in anything until after the death of the last one that remains on my land In testimony whereof I hereunto set my hand and seal the 18th of Nov. 1849 NEEDHAM SMITH THOMAS (X) SMITH Seal GILES SMITH Probate August Term 1850 JAMES _.
