Wayne County, NC - Will of Arthur Smith Sen., 1805 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Be it Remembered that I ARTHUR SMITH SEN. of Wayne County and the State of North Carolina being Very Low and feble in body but sound of mind and memory do think best in this condition to make this my will and I _____ and Dispose of my Estate in manner and form following Viz My Just Debts being first paid ITEM THE FIRST I give and bequeath to my beloved wife one mare called Blaze and saddle and bridle and one feather bed and furniture one cow & calf one Ewe ____ Lamb one sow and piggs & all the meat that ____ in the house that are intended for the house _____ & one iron pot one skillet one frying pan half dozzen of spoons one case of knives and forks ( to difficult to read) ITEM THE SECOND I give and bequeath to my grand son JAMES SMITH son of my son ARTHUR SMITH ____ _____ fifty acres of Land beginning at a sweet gum a corner then a direct course to a pine a corner up the branch adjoining the Land his father gave him, to him and his heirs and asigns forever and my will is that my Daughter in law LUCRETA SMITH have the free privilege of the above said lands of JAS. SMITH During widowhood provided She take care of my grand children without charging the Estate with Raising them that my Executors rent out the plantation for the support of said Children three of them POLLEY, JAMES and ARTHUR. ITEM THE THIRD I give and bequeath to my grand son ARTHUR son of my son ARTHUR Dec'd fifty acres of Land lying below and joining the above said land belonging to my grand son JAMES Also adjoining one hundred acres of land that I bought of RANDOLPH BRANCH Joining of the other fifty acres of my grand son JAMES which are 150 acres also a part of a new patent Joining the above said 50 acres and to the run of the Swamp containing eight acres In all 158 acres to him his heirs and asigns forever. ITEM I give and bequeath to my Son SAMPSON SMITH the land and plantation whereon he now lives as fur as the run of the swamp agreeable with the lines above and below, being three hundred and fifty five acres to him and his heirs and asigns forever ITEM I give and bequeath to my son DREWRY SMITH one feather bed and furniture ITEM I give and bequeath to my Daughter AVEY one hundred dollars one Ewe and ____ ITEM I give and bequeath to my grand Daughter SELAH SMITH Daughter of my son BENJA SMITH Dec'd one hundred acres of Land I took up Joining _______ _______ _______ to her heirs and asigns forever ITEM My will and desire is that after the hundred Dollars is raised for my Daughter AVEY is if there be anything or any part of my Estate left that it may be equally Devided among all my Children before any division to my beloved wife one stock of bees one pair of fire tongs one pair of ____ ______ And Lastly I do nominate and appoint my four sons JOHN SMITH, JOSEPH SMITH, LAZARUS SMITH & SAMPSON SMITH Executors to this my Last will and testament hereby making all other wills by me made null and void in acknowledged this to be my Last will and Testament in Witness whereof I have hereunto set my hand and seal this 9 day of July 1805 ARTHUR (X) SMITH Seal Signed sealed in presents of us EZEKIEL (X) HOLLAMON JOHN (X) POWEL _____ HOLLAMON Probate November Term 1805 Wills 1779-1927 CR 103.801.15 Folder 1805 Arthur Smith NC State Archives, Raleigh, NC This will has been most difficult, I left the spelling as it appeared to be. ______________________________________________________________________ Copyright.
