Wayne County, NC - Will of Ezekiel Smith, 1899

State of North Carolina
     I  EZEKIEL SMITH being in sound mind and memory and knowing
the certainty of Death and the uncertainty of life do make and declare
this my last will and Testament.
ITEM 1ST  I give my soul to God and my body to earth from whence it came.
ITEM 2ND  That my Exc. Bury my body in a decent manner and pay my 
burial and funeral expenses out of the first money coming in his hands 
as a part of my estate.
ITEM 3RD  I loan to my son BERRY P. SMITH one tract of land in Lenoir
County containing ninety nine (99) Acres to his use, his life time; and 
I give and bequeath the same to his children to have and to hold their 
use and behoof forever. Further I give to my son one Bed and the 
furniture for the same.
ITEM 4TH  I loan to my Daughter SARAH P. wife of WEBB HILL one tract
of land in Lenoir County containing ninety nine (99) Acres to have to 
her own use her life time. Further, I give and bequeath to her children 
the same land, to have and to hold for their use and behoof forever.
ITEM 5TH  I give and bequeath to my Daughter MARY JOHN, wife C.C.
SULLIVAN the sum of three hundred and fifty($350.00) dollars. The
same to be paid in three years after my death by my son JOS. OSCAR
SMITH it being in consideration of the valuable gift of Old Homestead.
Also I give her my chest to have and to hold the same to her only use
and behoof forever.
ITEM 6TH  I give and bequeath to my Daughter ROXIE ANN SMITH forty
two (42) Acres of my Homestead tract of land on the north west side
adjoining the lands of GEO. H. SMITH and including the house that 
HARRY SMITH (Col) now lives in , also eight acres of woodland in my
JACK JOHNSON tract, also two Beds and covering for them. Further
I require her to pay Grand Daughter M.M. HILL the sum of fifty dollars
in consideration of above gifts. I give the above to my Daughter ROXIE 
A. SMITH to have and to hold to her only use and behoof forever.
ITEM 7TH  I give to my Grand Daughter M.M. HILL the sum of fifty doll-
ars to be paid by my Daughter ROXIE ANN SMITH stated Item 6  above 
in consideration of her gifts of land, also I give MARY M. HILL one Bed
and covering for same, one rocking chair, to have and to hold to her
only use and behoof forever.
ITEM 8TH  I give and bequeath to my son JOSEPH OSCAR SMITH the
remainder of my lands in Wayne County also I give to him my entire
crop of cotton seed Fodder & meat and lard but on this consideration 
that the said JOS. OSCAR SMITH is to pay to MARY JOHN wife C.C.
SULLIVAN the sum of Three Hundred and Fifty ($350.00) dollars in
consideration of the gifts stated above. Further a years supply is to
be kept for the family. Also I give JOS. OSCAR two Beds and cover 
for the same, Also JOSEPH OSCAR is to have three years time to pay
MARY JOHN SULLIVAN without interest.
ITEM 9TH  I give and bequeath to ROXIE ANN and JOS. OSCAR my
household and Kitchen furniture jointly to have and to hold the same
to their use forever. Also I give ROXIE ANN one sow and pigs one
cow and calf remainder horses & I give to JOS. OSCAR SMITH to
have and to hold to his own use forever.
     In witness whereof I have hereunto affixed my hand and seal 
this the 25th day of Nov. A.D. 1893.

Addenda
I hereby appoint my son JOSEPH OSCAR SMITH
