First: I giv and bequeath unto my loving son James Henry Smith the tract of land that I am now living upon containing fifty five acres more or less it being the land which I purchased of my son Fremon Smith the deed having dat May 1847 the said land with all its improvements privileges and benefits to him the said James Henry Smith his heirs and assigns forever. 2nd: I give unto my grand daughter Nancy Smith one bed and furniture and my laom slays and harness. 3rd: My further will and desire is that all the remaining part of my property not herein mentioned shall be sold at a intern of six months that with all the money due me by notes and accounts be collected by my executor, and all my just debts paid of accts of the same, the balance of said money I wish to be equally divided between my two sons, Freman Smith and James Henry Smith. Lastly I do hereby constitute nominate and appoint my beloved brother James Shading executor to this my last Will and Testament. In witness whereof I the said Nancy Suggs have hereunto set my hand and my seal this 10th day of Septimber 1847. Woodward Joshua Moseley Wayne County – Nov Term 1847 Recorded Then was the above will of Nancy Suggs produced in open court and offered for probate and was duly proved in open court by the oath of Jno. J. Woodard a subscribing witness and offered to be recorded at the same since James Shadding executor therein named came into court and qualified ordered that letters testaments given to said James Shadding.
