Wayne County, NC - Wills & Estates - Jobe Warrick - 1878 File contributed for use in USGenWeb Archives by Cathy Blow rblow55@gmail.com I Jobe Warrick Sen of Wayne county North Carolina being of sound mind and memory but considering the uncertaintly of my earthly existence do make and deliver this my last will and testament in maner and form following that is to say First that my executor (hereinafter named) shall provide for my a decent beaural to the wishes of my relation and friends and pay all funeral expenses together with my just debt out of the first moneys that shall come into his hands as a part or parcel of my estate Item I give and devise unto my wife Clairssa B Warrick on hundered and fifty acres of land to be the west of my plantation and to include the buildings wich I now occupy as a home to have and to hold said one hundred and fifty acres to her during her life and after her death to James Brown Lonza ___on Joesire Brown and their heirs forever also give unto my wife C B Warick on clock & on feather bed and furnature her choice and all my kitchin furnature on sorrel mare I give to her fifteen barrels of corn six hundred pounds of pork, twenty five pounds of coffee, twenty five pounds of sugar, on barrel flour, and ten gallons molasses these last mentioned articles of provision I give to her for her years provision and are to be delivered to her by my executor out of the crop and provisions I have on hand at my death and if these are not on hand at that event my executor is directed to furnished them and deliver them to her within forty days after my death Item I give and devise unto my son James Warick one hundred acres of land to be the east of the plantation and adjoin the lands of E B Jordan and Zilpha Warick to have and to hold the same unto him the said James Warick his heirs forever I give and devise unto my son John Thomas Warick and his wife Careoline P Warick ten acres of land on which they now live that is to say I give them all the land which is inclosed by the fence which surrounds the home in which they at present live to be the same ten acres more or less to have and to hold the said inclosed piece of land unto them during their lives and the life the survivors of them and after the death of the survivors of them I give the said land to the use of said John Thomas Warick heirs Item I give and devise unto my son Council Warick fifty acres of land to be on the south of the plantation adjoing the lands of James Warick and C J Hudson, to have and to hold the same unto him the said Council Warick and his heirs forever Item I give and devise unto my daughter Alcy Collier forty acres of land, twenty acres where they now live, twenty acres east of the plantation adjoing the land of D H Bridgers and others, to have and to hold the same unto her the said Alcy Collier her heirs forever Item I give and devise unto my son Council Warick all the residue of my land not alread disposed of to have and to hold said residue of land unto him and his heirs forever Item I give unto my daughter Nancy Warick one feather bed and furnature belonging thereto Also unto my son Jobe Warick twenty five cents Mary Hudson twenty five cents Sarah Warick twenty five cents Ezekiel Warick twenty five cents Louis Warick twenty five cents Heskiah Warick sixty dollars the same in note I hold against him Also Benjiman Waricks heirs I give twenty five cents William Warick heirs twenty five cents Also my Betsy Hollomons heirs twenty five cents Item I wish my executor to sell all my personal property except that I have give to my wife and daughter Nancy and after paying my debts and the charges of administration to deliver the proceeds of the sale of said personal to my Council Warick And lastly I do nominate constitute and appoint Elisha B Jordan my executor to execute this my las will and testement according to the true intent and meaning hereof, hereby, utterly revoking and declareing void all other wills heretofore made by me Wittness my hand and seal this the 19 day of February AD 1878 Jobe (his X mark) Warrick Seal Witness Julius M Jordan D S (his X mark) Underwood State of North Carolina} Wayne County, } In the Probate Court Dec the 16th 1879 A paper writing purporting to be the last Will and Testament of Job Warrick, deceased, is this day exhibited for Probate, before the undersigned, Judge of Probate for said County, by E B Jordan, the Executor therein named, and the due execution thereof by the said Job Warrick is proved by the oath and examination of Julia M Jordan and D S Underwood the subscribing witnesses thereto. It is therefore considered by the Court, that the said paper writing, and every part thereof, is the last Will and Testament of the said Job Warrick and the same is ordered to be recorded and filed. And thereupon the said E B Jordan Executor as aforesaid, duly qualifies as such, by taking and subscribing the oath prescribed by law. W T Yelverton Probate Judge Wayne County:--In the Probate Court IN THE MATTER OF THE WILL OF} Before W T Yelverton Job Warrick } Judge of Probate E B Jordan being sworn, doth say : That Job Warrick, late of said County, is dead, having first made and published his last Will and Testament; and that E B Jordan is the executor named therein. Further, that the property of the said Job Warrick consisting of personal property is worth about $400.00 so far as can be ascertained at the date of this application; and that Clarissa B Warrick, Nancy Warrick, Job Warrick, Mary Warrick, Sarah Warrick, Ezekiel Warrick, Louis Warrick, Hezkiah Warrick, the heirs of Benjamin Warrick, decd, William Warrick's heirs and the heirs of Betty Holloman decd are parties entitled under said will to the said property.
