I Noel Ferrell of the State of North Carolina Wilson County, being of good and perfect mind and memory blessed be God, do this the 17th day of May in the year of our Lord one thousand eight hundred sixty nine make and publish this my last will and testament in manner following that is to say, That I give and bequeath to my beloved wife my land during her nattural life allso I give and bequeath unto her all of my property my stock hous hold & kitchen furnitur and every thing I possess during her life after her death I lend to Chray Ferrell one tract of land on the south side of Black Creek where she now lives during her life time or widowhood then I give said land to James W. Ferrell's heir belonging beginning at a soft rock on Black Creek nerley South to the back line the Privett line thence west to Josiah Barnes line thence with his line to Black Creek thence down the said Creek to the beginning. After my wifes death I give to my son Enos Ferrell one tract of land adjoining the said Cherry Ferrell tract beginning at the soft rock on Black Creek thence down said creek to Rebecca Lamm's line thence with said Lamm's line to the back line thence with the Privett line to Cherry Ferrells line thence with said line to the beginning. I give to my daughter Sarah one chest and one table. I give unto my grand son Jesse J. B. Ferrell if he stays with during my life I give him sixty acres of land cald the Saser place. I give unto Samuel one piece of low land on Black Creek adjoining the land he now has on after my death. I give to my son Noel Ferrell the tract of land where I now live on the north side of Black Creek beginning at the (unreadable) thence up the branch to Samuel Ferrells line thence nearly East a marked line to the light wood lake branch thence down said branch to the creek thence up the creek to the beginning. I give to my son Samuel Ferrell one loom and my part in the brandy still. I give blacksmith tools to my three sons Noel Samuel and Enos. After my death and my wifes after paying my just debt all my perishable property to be equally divided among my children and hereby and ordain my loving wife and my loving son Noel Ferrell Executors of this my last will and testament. Barnes Probate Judge State of North Carolina Wilson County In the Probate Court A paper purporting to be the last Will and Testament of Noel Ferrell deceased, is exhibited before me, the undersigned, Judge of Probate for said county, by Bede Noel Ferrell by the oath and examination of Gideon Hayes & Nelly Ferrell the subscribing witnesses thereto who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of Noel Ferrell that the said Noel Ferrell in the presence of this deponent subscribed his name at the end of said paper writing which is now shown as aforesaid, and which bears date of the 17th day of May 1862 (sic). And the deposeth further saith, that the said Noel Ferrell the testator aforesaid, did at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him, and exhibited, to be his last Will and Testament, and this deponent did therefore subscribe his name at the end of said will, as an attesting witness thereto , and at the request, and in the presence of the said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of the deponent subscribing his name as an attesting witness thereto, as aforesaid, the said Noel Ferrell was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge, information or belief of this deponent, and further these deponents say not.
