In the name of God, Amen, I Elizabeth Ferrell being of sound mind and memory knowing the uncertainty of life and the certainty of death do constitute this my last will and testament and hereby revoke all others made prior to this date. Item 1st It is my will that my Executor hereinafter named shall provide a decent burrial for my body at death. The expenses of the same shall be paid with the first money that may come into his possession as Executor. Item 2nd I will and bequeath unto my three neices, viz: Nellie Gifford Smithy Barnes and Catherine Ferrell daughters of Oliver Ferrell all of my wearing apparel and all of my spun cotton and cloth at my death, to be equally divided between them. Item 3rd I hereby will and bequeath unto my nephew Oliver Ferrell son of John Ferrell all of my property both personal and real at my death, (except the items mentioned in Item 2nd of this will) of every description after my just debts are paid off and discharged by my Executor hereinafter named. Item 4 I hereby appoint, name and constitute Dr Wm S. Anderson of Black Creek, Wilson County, as Executor to this my last Will and Testament In witness whereof I hereunto set my hand and Seal This August the 21 A D 1880 Elizabeth (her X mark) Ferrell (seal) Witness (signed) T. In the Probate Court A paper purporting to be the last Will and Testament of Elizabeth Ferrell deceased, is exhibited before me, the undersigned, Judge of Probate for said County, by W. S. Anderson the executor therein mentioned, and the due execution thereof by the said Elizabeth Ferrell by the oath and examination of T. J. Meacham and W. R. Newsom the subscribing witnesses thereto: who being duly sworn, doth depose and say, and each for himself deposeth and saith that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of Elizabeth Ferrell that the said Elizabeth Ferrell in the presence of this deponent subscribed his name at the end of said paper writing, which is now shown as aforesaid, and which bears date of the 21st day of August 1880. And the Deponent Further Saith, That the said Elizabeth Ferrell the testator aforesaid, did at the time of subscribing his name as aforesaid declare the said paper writing so subscribed by him, and exhibited to be his last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of the said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of the deponent's subscribing his name as an attesting witness thereto, as aforesaid, the said Elizabeth Ferrell was of sound mind and memory, of full age to execute a Will, and was not under any restraint to the knowledge, information or belief of this deponent: And further these deponents say not. (unreadable) Probate Judge W. S. Anderson being sworn doth say That Elizabeth Ferrell late of said County is decd leaving a last will and testament wherein W. S. Anderson was appointed Executor to said Will Further that the value of said estate is far as can be ascertained on the date of this application is about Three Hundred and fifty Dollars, and that Nellie Gifford, Smithy Barnes Catherine Ferrell and Oliver Ferrell are entitled as legatees under said will to said estate.
