Calling to mind the mortality of my body and knowing that it is appointed for all men once to die, I do make and ordain this my Last Will and Testament that is to say: First of all I give and recommend by Soul into the hands of Almighty God that gave it and my body I recommend to the earth to be buried in decent burial at the decision of my Executor nothing doubting but at the general resurrection I shall recover the same and as touching such worldly estate wherewith it thus pleased God to bless me with, I dispose of in the following manner: 1st Item: I give and bequeath unto John W. WOODARD my Grandson the tract of land whereon I now live and all of my stock, also my household and kitchen furniture with the exception of my bed and stead and bed clothing which I give and bequeath unto Eliza RAPER my grand daughter. Item 3rd?: And last I leave my trusty friend John W. WOODARD as my Executor to my Last Will and Testament whereunto I set my hand and seal this 24th April A.D. 1877. EVANS State of North Carolina Wilson County In the Probate Court A paper purporting to be the Last Will and Testament of Matilda HAWLEY, deceased is exhibited before me the undersigned Judge of Probate for said County by John W. WOODARD the Executor where in mentioned and the due execution thereof by the said Matilda HAWLEY by the oath and examination of John D. ADAMS, Jas. P. EVANS, the subscribing witnesses thereto who being duly sworn, doth depose and say and each for himself deposit and saith that he is a subscribing witness to the paper writing now sown him purporting to be the Last Will and Testament of Matilda HAWLEY, that the said Matilda HAWLEY in the presence of this deponent subscribed her name at the end of said paper writing, which is now shown as aforesaid, and which begins? date of the 24th day of April 1877. And the deponent further saith, that the said Matilda HAWLEY the testatrix aforesaid did at the time of subscribing her name as aforesaid declare the said paper writing so subscribed by her and exhibited to be Last Will and Testament and this deponent did thereupon subscribe her name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of the said testatrix, and this deponent further saith that at the said time when the said testatrix subscribed her name to the said Last Will and Testament as aforesaid and at the time of the deponents subscribing her name as an attesting witness thereto, as aforesaid the said Matilda HAWLEY was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge, information or belief of this deponent. And further these deponents say not. John D. ADAMS Sincerely Sworn and Subscribed this 1st day of Dec. 1877 before me. H. C. WOODARD, do solemnly swear or affix a Last Will and Testament and that I will and truly administer all and singular the goods and chattels rights, and credits of the said Matilda HAWLEY and all other duties appertaining to the charge reposed in me, I will faithfully and honestly perform with best of my skill and ability so help me God.
