Hocott of the County of Wilson and St of North Carolina being of sound mind and memory, but feeble in body and considering the uncertainty of my earthly existance do make and declare this my last will and testament, in the manner and form following - that is to say: First - That my executor/herein after named shall provide for my body a decent burial and pay all funeral expenses together with my just debts howsoever and to whomsoever owing out of the moneys that may first come into his hands as part and parcel of my estate. Item - I give and devise unto my Brothers James Hocott and Richard Hocott, all of my land, negroes, and property of any and all kinds whatsoever, which I now have in possession or have any rightful ownership to whatsoever also all that may result to me by and after the settlement of my Father's estate to be equally divided between them - Said division to be made in any manner they may select. Lastly, I do hereby constitute and appoint my Brother Daniel Hocott my lawful executor to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof - hereby revoking all other wills and testaments by me heretofore made: In testamony whereof I the said B. F. Hocott do hereunto set my hand and seal this the 12th day of January AD 1857. Signed Benj. F. Hocott (X his mark) Witnesses: T. C. Davis William M. Gay January Term AD 1857 Court of Pleas, 1 quarter Sessions, Wilson County The foregoing paper writing importing to be the last will and testament of Benj. F. Hocott, Decd., is exhibited for probate in open court, and the due execution thereof by the said B. F. Hocott is proven by the oath and examination of Wm. M. Gay and T. C. Davis, the subscribing witnesses thereto, It is therefore considered by the court that the said paper writing and every part thereof, is the last will and testament of the said B. F. Hocott, and the same is ordered to be recorded, filed, and the Executor therein named being in open court and renouncing the Executorship on Motion Letters of administration cum testamento annexo, is granted to Jonathan Dew, upon his entering into Bond in the sum of Five thousand Dollars with John Dew, and Daniel Hocott, as his Sureties Bond filed, and administrator qualified by taking the prescribed oath.
